NLRB Rules Players at Dartmouth May Unionize.

Featured Replies

https://frontofficesports.com/nlrb-rules-that-dartmouth-mens-basketball-players-are-employees/

On Monday, the National Labor Relations Board issued a landmark ruling that could shatter the NCAA’s amateurism model. Dartmouth men’s basketball players are considered university employees under U.S. labor law—and therefore are eligible to unionize....

Ivy League athletes do not receive athletic scholarships like other members of Division I programs, but the NLRB regional director found that the other forms of compensation they received, like apparel, were enough. The lack of profitability also did not appear to be a deterrent from the NLRB declaring the players employees.

This may have a MUCH bigger impact on college sports than NIL and Transfer Portal Combined.

Of course if players are now considered employees then housing, tuition, tutoring, and even meals would become taxable income.

Some things to consider, if a mens basketball team unionize can the women's soccer team choose not to? If they do decide they don't want to unionize then what kind of pressure will be placed on them to get on board by others?

This too will be a mess...just wait.

Things are moving so fast.

I am interested to see where all the "corrections" take us.

Unionizing sounds great in theory, but just like JD alluded to, if they are now employees, they have to pay taxes. How’s that going to work?

At this point, if any teams or athletes tried to get more out of that game, EA sports would likely tell them to kick rocks. It's too far along, they'd probably just say ok, you won't be included in the game.

Absolutely true. I definitely can see it throwing a kink in to future editions.

Perhaps, but it sounds like for now, it's only the Ivey league schools because they don't receive athletic scholarships.  Unless I misinterpreted what the article was saying.

I was mostly joking about being worried about EA College Football.

I think that it's only Dartmouth because their players are the ones that asked for the ruling.

But now that the NLRB has determined they are school employees, that same ruling would cover all college athletes. Each team doesn't have to ask for a ruling now that it's been decided for one.

True, my apologies!

I've been looking forward to it for years!

Not to mention, I can see the administrations getting together and saying that if they are getting paid, no more scholarships.   Here's your class schedule.  Tuition payments are due on the 15th of every month, unless you want to pay it all up front.

NIL money is already taxable, and Ivy's don't provide athletic scholarships so technically neither of these are issues they don't already face. As far as schools that do provide scholarships, that's certainly their choice, but it won't exactly be a good recruiting tool.

Who's filing taxes for those receiving NIL? Because it certainly isn't the athletes.

Doesn’t matter who files, but the athletes are responsible if they choose not to file. And with the size of some of these deals, there’s a pretty nice tax bill that will come with it. Choosing to ignore it is not a good idea. Hopefully those that secure these deals are getting good advice.

I'd say we'll see the first tax evasion prosecution of an athlete for unpaid taxes within next 18 months.
