Still could have easily knocked the car out of gear trying to back up after the shooting started. Either way, the fact the car was in neutral, drive or reverse isn't germane to the situation IMO.

It was either in neutral or reverse. The car was moving forward then it rolls backwards. So it was either in reverse or neutral?

If her hands were up when she was shot (no idea if they were or not), they could have fallen and hit the shifter after she was shot. Gravity would've taken over her hands/arms.

There is a lot wrong with this whole situation. First of all they all shouldn't have been trespassing or drinking that is the first thing wrong and what led to the series of unfortunate events to come. However what they did also was no different than a lot of kids are doing at the college age, it doesn't make it right but it is the reality of things. Now on the video he is on the side of the car, and she should have stopped when he said to stop. However after that, that is where I am very skeptical on things he did. I don't think for a second she was trying to run him over, but the fact that he was on the side of the car and trying to move forward on the car while the car was moving probably did lead to his foot being ran over. Which I think probably led to him jumping up on the car so avoid his foot or leg getting ran over. However obviously the car wasn't going very fast or even far at all, because the car wouldn't have gotten back into the camera view after she was shot with the car in reverse. The car couldn't have been to far away at all, which shows she never went to fast at all or it would have been further down the road.

 

Now when you also add in the fact that the car did end up in reverse, shows that she would have had to shift it up herself to go from drive which is like 4 clicks down when shifting and then to get back to reverse she would have had to move it up herself before getting shot. So maybe he didn't realize she was stopping to put it in reverse, however at that point obviously the car wasn't really moving forward anymore. So at that point the main danger for him would have gone down drastically. Then when you throw in the fact that she was putting her hands up right before she got shot, shows that she probably saw him get his gun out and start to point it at her. Which I don't know how cops are taught, but I would think that is a sign that a person is giving up and the need to shoot them is no longer there. I know all this happens in seconds, so its easy to sit back and diagnose the whole thing. However since he is a cop, cops are trained for many situations and I definitely understand cops also have to keep themselves safe. However to shoot 4 shots at someone who was putting their hands up, and with the car probably barely moving at this point since it was being shifted into reverse does makes the need to shoot at all go down quite a bit and to do 4 shots with other people in the car definitely could be considered excessive.

Great post! Also add in the cop said the car was picking up speed when he was on the hood. That just doesnt sound right if she had the car in neutral or reverse.

Well for a friend so shift the car the car probably already would have already been stopped for the car to have quickly got back in camera view after getting in reverse. So if the car was basically stopped and not accelerating then gets back to the need of why shoot? Secondily maybe I doubt a passenger would lean over to shift it when shots are being fired. I would assume once he got his gun out and pointing they probably all started to try to duck.

 

As Guru said he has been found of no wrong doing. However there is a lot of things that are big question marks on how things went down once it got out of camera view. The police also messed up by not asking for outside help into investigating it from the beginning.

 

Both parties did things that shouldn't have happened that led to this tragic death imo. Prayers are with both.

I can throw my arms down and hit my automatic shifter from drive to neutral. Are you thinking of a column shifter? If so, then I would think it would be impossible. But for a shifter by the console, it could be done pretty easily. I have no idea what type of shifter she has.

Maybe the car was a "Stick", but at this point it doesn't matter.
