Former Bengals cheerleader Sarah Jones sued TheDirty.com for defamation based on certain things posted at the website in 2009 regarding Jones’ alleged sexual proclivities with Bengals players and students at the high school where she taught. Jones later pleaded guilty to having sex with a student at Dixie Heights High School.

 

Jones and the victim, Cody York, currently are engaged to be married.

 

The first time the case went to trial, a jury was unable to reach a verdict. Of the 10 jurors, one or two resisted finding in the plaintiff’s favor.

 

“The hangup everybody couldn’t get past was her criminal side of her life, which really had nothing to do with this case,” juror Debra Spencer told FOX News, via WCPO-TV. “There was a couple that couldn’t get beyond it and that she lied.”

 

Former Bengals kicker Shayne Graham appears on Jones’ list of potential witnesses. His testimony was recorded via a pre-trial deposition, which may be played for the jury. Graham, according to the witness disclosure, is expected “to deny the allegations posted by the Defendants.”

 

Adding to the intrigue is a fairly public pissing match among some of the key players. Jones is represented by Eric Deters, who once claimed after questioning former Bengals receiver Chad Johnson in a different matter than Johnson has “the mental agility of a small soap dish.” And Deters has called Nik Richie, owner of TheDirty.com a “scuzzball” and vowed to “finish him off at the retrial.” Richie has vowed to never pay Jones a dime, and he has taunted Deters for a recent 60-day suspension from the Kentucky Supreme Court. (Deters is able to handle this trial because he’s appealing the decision.)

I got a big laugh out of Shayne Graham being used as a character witness and Deters' old soap dish comment about Johnson.

To be fair, Jones defamed herself with her actions at Dixie. Shouldn't she be embarrased enough? Does Eric need more publicity? Whatever happened to 'letting sleeping dogs lie'.

 

Going to have to blame mom for not putting a stop to this whole fiasco. Didn't respect her much as a principal but have to think she may be a worse mother.

What happened at Dixie and what the lawsuit are about are two completely different things and the comments by the Dirty were before the Dixie stuff came to light. From Wikipedia:

Her ex Nate . . cheated on her with over 50 girls in 4 yrs.. in that time he tested positive for Chlamydia Infection and Gonorrhea . . so im sure Sarah also has both . . what's worse is he brags about doing sarah in the gym . . football field . . her class room at the school where she teaches at DIXIE Heights.” [1]In which, commentator Riche responded:

 

“Why are all high school teachers freaks in the sack?” [1]Jones sent another email to thedirty.com requesting that the posts be removed but her requests were left unanswered.

On December 23, 2009, Jones filed this action against Dirty World, LLC, Richie, and two other entities bearing names that include the phrase “Dirty World.” On August 31, 2010, Jones filed a Second Amended Complaint in which she brought about claims of defamation, libel per se, false light publicity, and intentional infliction of emotional distress.

Never took a piece of candy from the store as a kid? Because once a thief, always a thief. Or maybe you sped (a criminal act).. Once a criminal, always a criminal.

If you can realize the two events have nothing to do with each other, there is no help for you. Saying in a public forum someone has STDs has nothing to do with if 3 years later they slept with someone they shouldn't have.

If Nic Richie looses this case it will be detrimental to all website owners including this website. If an owner can be held liable for things members post then it doesn't matter if you have rules or moderators you can still be at fault. I would think Guru would be rooting for Nik. 1 bad source and he could loose everything.

I agree to an extent with what you are saying BUT in the case being discussed Nik was contacted multiple times and asked to remove the posts. Nik chose not to. That is where the lawsuit lies.

 

If something got posted to BGP and someone contacted G to take it down because it was false or defaming (which is against BGP rules), I have absolutely no doubt in the world that G would do the right thing without hesitation.
