May 1, 201313 yr I've defended the 2nd amendment and will continue to do so. That said what moronic idiot gives their 5 year old a gun? Both of those parents need to be charged with negligent homicide and endangering a minor. But also not securing the weapon. Standing it in a corner? What idiots, and I'll bet other weapons are not secure as well. What a price to pay for not being diligent about gun safety. God be with the family and especially the brother who will live with this his entire life.
May 1, 201313 yr the gun almost assuredly was not only loaded, but cocked in the corner. The gun was a cricket, like we own. The cocking mechanism on the gun is very tight. My 5yo wasn't strong enough to c0ck the gun on his own at that age. If that's the case, the parent was unquestionably and even more than face value responsible for this happening. I hate it for the family. I can't imagine the anguish.

And said person, when caught, is prosecuted for that crime. So are you saying the 5 year old boy should go to jail like the 10 year old car driver you just mentioned? :idunno:
May 2, 201313 yr The kid will be messed up for life, knew a kid like that and his life is a ruin. The family just got ruined. Probably divorce and all suffer for,the rest of their lives. Jail will do no one good in this case. A terrible accident and terrible,judgement.
May 2, 201313 yr New take on this. It has been decided that no charges will be filed. I disagree with that but what does that matter. However what if the 2 year old that was killed wasn't the sibling of the 5 year old but a neighbor. Still a terrible thing, the 5 year old is still likely scarred for life but should charges then be brought since the family hasn't suffered a direct loss?
May 2, 201313 yr IMO a good thing that no charges will be filed. They will serve a prison sentence the rest of thier lives. Im sure they would love to go to jail if it brought back their kid.

What about if a drunk parent has a car accident and they child is killed? Should charges be filed? I understand that the parents and the surviving child feel remorse but IMVHO this was an extremely careless act and is deserving of criminal charges.

Yes if their child killed the neighbors kid then yes prosecute them. If they are drunk and kill their child while driving, yes prosecute the parents.

So the neighbor's child is more important then their own? What's the difference a child is still dead? If you cause the death of your own child you shouldn't be prosecuted because you feel remorse? And I echo Hatz sentiment, only drunken negligence should be prosecuted.
