This is just nonsense. Does it truly bother you that much that I question some assumptions?

I certainly haven't reached a verdict on the matter. I'm sure plenty more information is available. I've only questioned your assumptions.

No, you went off the reservation and assumed I thought because she was a lesbian she couldn't have been raped.

Your "theory" was that it was more likely that the accuser was a lesbian who had gone straight and was covering her tracks. Ergo, your reasoning was contingent on her sexual identity. You even said it was your heterosexual perspective. I responded that I found that assumption troubling.

My theory was the the partner found them, then got her assumption on. That we know is likely true. What happened before is unknown, and what she says she saw will likely be the crux of the case for the prosecutor. Sadly for the drunken wrestler, he has no one to bail him out if indeed it was consensual and just a bad decision.
My knee-jerk reaction, in most cases of rape, is to always be at least a little bit skeptical. It's the only crime that you can have a "he-said, she-said" case with no evidence, and the public/courts still overwhelmingly side with the accuser.

All it takes is someone (male or female) to make a rape accusation and the accused's name/life is forever tarnished or ruined.

Brian Banks thinks you all are rushing to judgement.

As to the bold, statistics show otherwise.

This is also something that troubles me, spindoc. If memory serves you are among the group who believes we as a society should be more armed to protect ourselves, especially women. Had a similar event happened (a woman alleges she was about to be raped) and the woman shot the man down, would you be floating theories that she had acted out of malice or that the man was most certainly going to rape her and needed to be shot?

Indeed if they were sober, and he attacked her, absolutely.

But isn't it still a "he said, she said"?

Not without more details. Similar event here was that the woman woke up to being raped and shot him. Then you have to take into account the possibility of her getting a gun, where the gun was located...you need more details, just like here.

Well, there's an awful lot of conjecture to dream up a scenario, however, when alcohol is involved, and let's say the same incident occurred and the "partner" shot the man, how would we know if it was rape or not? Was the "attacked" screaming? Doesn't say so in the story.

The problem in this one, in my opinion, this case will likely rely on the partner's testimony as to what she saw. I have to wonder if it will be factual because of the relationship to the accuser. Sexual orientation aside.

The problem with the story as I read it is there is a third party "She said", not the alleged victim, but a third party that seems to know everything that happened, and that is what makes the story seem odd.

Maybe, but I imagine there are a lot of details left out there. This article was mainly reporting on the arrest. I'm sure the police are interviewing everyone at the party, cross-checking stories, etc. We don't even know if the guy is denying it yet. Which is why I disagree, strongly, with the notion that there isn't enough information to make a judgement, but that she is probably lying based in te information.

Damn I hate I have to do some work right now. This thread is already awesome. I can't wait to read the article with no information so I can choose sides.
