I agree with a lot of the things you write on here and have a good amount of respect for you, but those are very very bad examples. Pot and Alcohol are virtually the same, except one has less effect, is cheaper, and allows you to to make better decsions while under the influence than when under the other one.

True, which is also one of the things that troubles me about legalizing the drug. What tests are there for determining how "high" someone currently is.

 

To your second point, the same is true though of alcohol. That is why it is simply illegal to operate a motor vehicle while under the influence. Example. If you have a tire blow out or some sort of mechanical failure and crash and your BAC is .08, was your crash due to the alcohol? Probably not. If MJ were made legal, I would think there would have to be some sort of testing similar to that of a breathalyzer, because being high and operating a motor vehicle should be illegal even if the drug is made legal.

 

This is one of the few (maybe the only?) argument that I'd buy for not legalizing marijuana. It is difficult to test how high or if someone is high. I believe marijuana stays in your system around 30 days with your typical drug test, depending on the person. So, that same test would not be valid if there was an accident.

 

However, I have a hard time believing that science is not capable of a better, more accurate & more timely test to detect marijuana use. But then again, I have no idea.

 

With that said, how would you feel about the typical field sobriety tests being performed? Not the best indicator for marijuana use, but still a pretty good indication of where the driver is in terms of reactions, reflexes, etc.

I think the FST is a good indicator, but not near an absolute. The breathalyzer is what makes or breaks the deal for me though as it is more concrete empirical evidence.

Guru or one of our law enforcement peeps can help us out here, but I believe that you can get a DUI from being under the influence of illegal drugs as well.

No, they are not exclusive to alcohol; however, driving laws (statutes) are typically state based, so they may differ from state-to-state.

That is crazy. I would've expected it to be high, just not that high.

How do you go about issuing a DUI for somebody in that type of situation?

 

Obviously a breathalyzer wouldn't work. Field Sobriety tests? Or do you arrest them on suspicion of DUI and then do blood work / urine tests?

I can't but that wasn't my point about your post I should have bolded.:thumb: I was trying to point out that legalizing Pot isn't even in the same world as selling aborted fetus's or your other example. My question to you is if you feel so strongly on Pot what are your feelings on Alcohol? Because Alcohol is worse than Pot, and that is fact.
