Texas defies World Court

Featured Replies

HOUSTON (AP) -- The planned execution this week of a man convicted in one of Houston's most brutal murder cases in a generation has become among the most contentious in the state that has the nation's busiest capital punishment system.

International attention has been focused on the execution of convicted killer Jose Medellin scheduled for Tuesday. The International Court of Justice, also known as the World Court, said the Mexican-born Medellin and some 50 other Mexicans on death row around the nation should have new hearings in U.S. courts to determine whether a 1963 treaty was violated during their arrests.

Medellin, now 33, is the first among the 50 who is set to die.

His attorneys contend Medellin was denied the protections of the Vienna Convention, which calls for people arrested to have access to their home country's consular officials. He has been in the United States since the age of 3.

I think this statement sums up the situation:

"The law is clear: Texas is bound not by the World Court, but by the U.S. Supreme Court, which reviewed this matter and determined that this convicted murderer's execution shall proceed," said Jerry Strickland, a spokesman for the Texas Attorney General's Office.

I smell a capital punishment debate in 5....4......3......2......1

Nah, we just had one a couple of months ago, didn't we?

You should check out the thread titled The Cycle of the PR Board

You all can debate capital punishment all you want, this clown needs his ticket punched on a one way ticket to eternity.

In the legal frenzy to save Medellin, the fact that two girls were killed is being lost, said Randy Ertman, father of one of the victims.

"This is not about vengeance. This is not about a deterrent or about closure. It's about the punishment," Ertman said. "Everybody wants me to say closure or vengeance. I'm never going to have closure. It's just a miracle word that's going to make us feel good, but it ain't going to happen."

The World Court needs to mind their own frickin' business. This animal was in the U.S. 16 years when this crime occurred. Either he is a U.S. citizen subject to our laws, or he's an illegal alien who overstayed his welcome.

"Medellin, on death row for almost 14 years, (he's 33 now so that means he was 19 at the time) was one of six teenagers (six teenagers with three of them 18 or 19 at the time, two were 17 and one was 14) arrested and charged with the gang rape and murders of Elizabeth Pena, 16, and Jennifer Ertman, 14. The two Houston girls, returning from a friend's house, took a shortcut home and stumbled on a group of teenagers drinking beer after initiating a new gang member.

Evidence showed the girls were gang raped for more than an hour, then were kicked, beaten and strangled. Their bodies were found four days later."

The fact that namby pambys will find every way to make a sympathetic character out of this beast is pathetic.

Go Texas! :thumb:

I already read it.

As to the topic, this was a truly heinous crime. Does Vienna even apply to this guy considering how long he spent in the U. S.? But I don't see the harm in reviewing cases.

Word to the wise, if you're going to commit a capital offense, try not to do it in Texas.:fire:

I am not sympathetic to this person at all...but I still think rotting in prison for the rest of your life is way worse than dieing.

You say Go Texas, but I believe that Texas has actually executed a mentally retarded person in recent history;I may be wrong let me check.

Here is one instance off hand

I am still for long term torture for people like this. Physical or psychological, makes no difference to me.

[Texas is one of 25 states that allow the execution of retarded killers, while 13 other states have prohibited the practice.

It doesn't really sound like Texas is out on their own with this policy. FWIW, I wouldn't have a problem with life without the possibility of parole for this individual.

Torture is never the answer. The point of having a justice system is so that we can be above such things.

Idealistic drivel. Torture is an appropriate punishment.

I don't believe in the concept of "cruel and unusual punishment" for crimes that would normally receive the death penalty.

What you call Idealistic Drivel is what keeps our society from sinking back 400 years and pillaging and raping conquered lands. Terrorists and murder's are that because of the methods they use. We cannot condemn their methods one minute and then use them ourselves for the "greater good". Once we go down that path, then there will be no turning back untill one day we are the ones murdering innocents and driving bombs into buildings;all for the good of America.

Torture is never the answer. The point of having a justice system is so that we can be above such things.
So, in your value system, we can't eliminate human cancers who willingly commit vicious acts of animalistic barbarity from our society, but we can slice and dice and suction the brains out of innocent humans in their mother's wombs and that makes us virtuous?
