The first time she was probated. The second time she got a 45 day sentence. I do this stuff on a regular basis, and a 45 day sentence is absolutely right on the money. She could have been given the same sentence for probation violation or contempt. Next question is, is she eligible for home incarceration. Home incarceration is absolutely and positively at the discretion of the judge and usually the prosecutor, too, and NOT the jailer, no matter how much the celeb faces want to say otherwise. The law give her credit off her sentence for good time. When a court order says "serve the time, no H.I." and the sheriff doesn't follow it, he needs to bring his own toothbrush because he's going to be held in contempt, too. The interesting part here is the hearing. Everybody kept talking about medical condition, medical condition. The defense lawyers kept asking for a hearing in Chambers about the medical condition, but even with the judge egging them on, couldn't produce document one about a medical condition, and certainly didn't have any medical personnel there with them. I GUARANTEE you had she had even the slightest evidence of anything real, they would have had a truckload of documents and an army of doctors ready to go, pre-filed, and ready for battle. And what celebrity has their lawyers ask for a hearing in chambers? The medical conditon is bunk, and the judge knew it. He knew that they had tried to sneak a psychiatrist into the jail, and he knew that the lack of presence of anybody at the hearing indicated that the psych hadn't found anything. Part of the Judge's anger, I guarantee, was at the defense for trying to pull this stunt to sidestep him. The courtroom theatrics by mother and daughter are typical of reactions I see everyday in court. Pfui. She will serve her 20+ days in luxury. I am now a bigger fan of Martha Stewart, who didn't whine and complain about her much longer sentence and took it like a trooper.
June 9, 200719 yr Her last no contest was a plea deal to avoid the DUI related charges (she blew a .08 BAC) In KY this is not suppose to happen, but does. The prosecutor in Hilton''s case decided to offer a plea deal, imho THAT was the special treatment. ALL DUI's should be prosecuted with no plea deals. I'm sorry anybody has to go to jail, but she brought this on herself.

June 11, 200719 yr I am by no means a Paris Hilton fan, but in trying NOT to treat her differently than any other person guilty of the same type of offense, she IS being treated differently.

I hate the example she sets for young girls and I find it deplorable that she would receive special treatment because of her wealth and status. Still, I just can't take any joy in seeing another human suffer and cry as she is. I certainly hope the lesson sinks in for her and she comes out a better person. :thumb: :thumb:
