Incident involving a player and fan during Paintsville/Williamsburg game

Featured Replies

If that was my son, there would’ve been TWO incidents on that sideline.:idunno:

Right, depending on the player/parents the "perpetrator" in that video could have ended up in the hospital or worse.

If Paintsville won't do anything themselves PUBLICLY, the KHSAA should definitely do something to the individual and the program. A year of no home games in any sports maybe. If this happened once or more at my high school, I would be ashamed. Sad thing is nothing will happen because the offender is "a good kid" or if you speak up you have "no hometown spirit". Those from Paintsville that have spoke up should be commended.

It has already been pointed out anyone on the sidelines is a part of the organization and he should never be allowed on the sidelines again at any KHSAA event.

I respect that sentiment, however the KHSAA has stated that it is not within their jurisdiction. I can confirm that he is no longer going to be on the sidelines going forward.

I am not tech savvy enough to embed the news paper article, but a Williamsburg local paper ran a story on this and contacted both the KHSAA and the man involved. KHSAA stated (paraphrasing here) that since it was not a representative of the school, NFHS does not govern. Someone please post if you find the article.

All he gets is a slap on the hand?

To me all the school can do is ban him from any events they host. If the student athlete wants to press charges I guess that is an option. However, members of Ponder’s family went to jail that night for assaulting a game official so they may be hesitant to work with the local authorities. Overall, just a bazaar scene that ruined a great contest.

You’ve been the best source on all of this. My frustration is only moving him away from the sidelines, to me that’s really not a punishment. He needs a lengthy suspension from athletic events.

I agree. I can only confirm he isn’t going to be in the sidelines. I assume he isn’t going to be allowed at any Paintsville hosted events going forward.

I do not know the law well enough to know if law enforcement can press charges on someone if the victim does not file a complaint? My gut tells me there is much more coming on the legal/ lawsuit side.

Yes the prosecutor can, the law is black and white, they don’t need a victims word to press charges if they have evidence of a crime.

That said, I’m not sure if the state would go after him without the parents being really vocal.

I understand the KHSAA wanting to wash their hands of incidents like this but if the Paintsville powers that be have him on the sidelines protecting cheerleaders then he is absolutely representing the school in an official capacity.

That is why I think any investigation should be done by the Kentucky State Police and not any local authorities that could have several potential conflicts of interest.

If you don't have a victim reporting a crime then no, nothing is going to happen.

It's a shame for anything like this to happen anywhere.

From what I am being told this was a “self appointed position”, convenient, I know. However, I personally do not think he was given that title by anyone.

In other words Paintsville is not controlling who is on their sidelines...

Seriously, thanks for all the good information on this and again welcome to BGP! :thumb:

There is a cautionary tale in this that may apply to all overly involved parents who are active on the sidelines at any organized athletic event. And I was one of those and eventually became the official unofficial team photographer.

But even if you do not do something dumb - as seems real apparent here - you are taking a risk being on the sidelines. The physical risk is somewhat obvious. But there is also liability and related financial risk. That is less obvious but should not be ignored. You can become liable for injury or damages - even if you do not something dumb or foolish. Its rare but it can happen.

To do pictures inside the fence at a local University I had to sign not only a waiver but a document that assured them that I had a minimum level of liability insurance. It did enforce the issues that can happen when you are too close to the action. Its really something to think about if you do not carry significant personal liability umbrella insurance or have a coaches card that provides supplemental insurance, etc. If something bad happens on the sidelines - even purely by accident - you could be sued.
