The 20th Amendment says that in such a scenario, the Vice President-elect would become President. I am not sure if 'the election' in the paragraph above is the general populace election day (Nov 8th) or if that is the electoral college election - since it is the one that constitutionally matters.

Was this just something the director did to say "Hey guys, we're still out here." The case was never really closed, just put on back burner after nothing worthy of prosecution was found. Like the FBI's 9/11 case is still technically open. What a mess all this is.
