Bill would restrict how nursing home violations could be publicized

They are. The problem is the poor are going to get the shaft, as they always do. Those who can afford private care or have insurance plans will be ok. Those using Medicare and Medicaid are in trouble. They are going to a managed care format. Increasing costs from regulations are combining with shorter stays and rate reductions. That results in lower staffing levels to save money which results in the lack of care cited in posts above. Even the non profits run by people like the Carmelite Sisters will struggle to stay open. Makes me not want to grow old.

If this is the way you feel I don't understand why you appear to be for the legislation. All the legislation will do is make it easier for the lower quality Nursing Homes to get over on patients and it will make it easier for the high priced Nursing Homes to cut corners like the low quality ones do now.

The Trial Lawyers are the ones standing up for the victims of abuse/neglect. If not the Trial Lawyers who?

And in this case are you saying it is okay for the Government to tell a private business they don't have free speech?

I get what you mean I don't like any speech to be restricted. But if you are trying to profit off said speech that kind of speech is restricted all the time in our society.

I'm confused on how it will allow nursing homes to get over on the public, if the information produced is truthful.

It's the same as a health inspection for a restaurant. The newspaper will publish intial score and then also the score for the follow up inspection after the violations are corrected.

There are good trial lawyers but the industry as a whole is a cash grab proffesion. I'm all for cash grabs in a free society but let's not paint them as saints.

On patients.

This legislation is an attempt to curtail legal advertisements looking for Nursing Home victims of abuse/neglect. If you make it tougher, the only people that are going to suffer are some of the patients.

Health Inspection is your analogy? A private law firm is not an arm of the government and should not be required to say good things about nursing homes just because they are point out bad things about nursing homes.

In this case they are saints to the victims.

If we are going down that road then I guess newspapers and TV stations shouldn't be able to profit from the advertisements either. I guess we need legislation for that too.

I don't see it the same way as you, I believe more information is good.

Julian Carroll is right. This legislation won't survive a court challenge because it restricts free speech. A state law saying you can say A but also have to mention B and C violates the concept of free speech.

Nursing homes can be scarey places. Ideally, families should do a lot of homework in advance. When my grandmother became ill and hospitalized, we were told we had to find a nursing home, and if we did not find one quickly, she would be placed in the first available one the hospital could find.

As you might expect, the good nursing homes had waiting lists, and favored those whose finances guaranteed that they could pay at least two years cash. It was frightening. We were lucky because initially my grandmother did not need a high level of care, and by the time she did, her name came down on a list. The old Saint Charles Nursing Home, run by nuns, was a God send. It was the only nursing home we could find that provided excellent care regardless of ability to pay.

Many years ago I worked at a nursing home. The owners had good intentions, but Medicare and Medicaid had such poor reimbursement that it was impossible to provide quality care. In addition, the job of a nurses aide is very hard and turnover was quick. They hired almost anybody just to have a body, and thefts were very common.

My advice would be, wherever your loved one is, visit frequently, at different times, and show appreciation to those who care for your loved one. If you suspect abuse or a crime, do not hesitate to report it, even to outside agencies if you need to.

Exactly, the Nursing Home Industry is riddled with issues that all result in lower quality care for the segment of society (sick, old, weak) that have the least ability to stand up for themselves.

In other words everyone, this is the LAST industry that should be allowed to make it tougher for victims to seek relief/justices through our legal system. Frankly, I don't know how the lobbyist and politicians that take the lobbyist money can even sleep at night. I think this type of legislation is despicable.

Laws that are affecting the elderly and children in a negative way are totally unacceptable and the REAL reason I struggle voting Republican. Our least able to stand up and protect themselves are taken advantage mostly by big business because they are costly to care.

We do have legislation about what type of ads can be run on TV stations ?

Seen any ads on TV about cigarettes recently. By your definition the government should not be allowed to restrict their advertisement.

You are right LB. Cigarettes are legal, the government should not be allowed to restrict their advertisement. And if the government is going to restrict their advertisement, they sure as heck should not be able to tax and profit from cigarettes.

This is just another example of the government telling us what to do while they sit back and collect their money and use that money to figure out more ways to tell us what we can and cannot do.

My point in this thread wasn't that I agree with the law but that it isn't unprecedented. I agree that speech shouldn't be restricted but the government doesn't care about freedom, just telling us serfs how to act.
