January 27, 201511 yr Vanderbilt Commodores rape case defendant Corey Batey testifies that he has no memory of any assault - ESPN
January 27, 201511 yr Author You have to think that there are some people at Penn State who are not appreciating the timing of this given the James Franklin hire. Honestly, as someone whose been to court for work and/or school more than a few times, this is some of the worst testimony and details that I've seen, and this is coming from someone who saw a lot of things in a Legal Aid setting.
January 28, 201511 yr Author GUILTY! I really liked what the Judge said to them and how he blasted their "college culture" and "too drunk to know" defenses. One of the most heinous parts was that one of the guys who was found guilty of rape (the one who said he didn't participate because he "wasn't able") was her boyfriend at the time and encouraged the others to assault her. Two guilty verdicts with the other two yet to stand trial. One of the most disturbing parts of all of this: apparently things weren't investigated initially, and the only reason this came to light was because someone had vandalized the dorm's door, breaking it, and in reviewing the security footage, officials saw them carrying in a girl who was passed out.
January 28, 201511 yr Author Jury finds ex-Vanderbilt football players Brandon Vandenburg, Cory Batey guilty of rape - ESPN
January 28, 201511 yr Author Very disturbing story. Drunk is not a defense. Agreed. Especially one of the guys who claimed he was "too drunk" was videoing the whole thing and wasn't too drunk to tape and send it out to others.
January 28, 201511 yr Batey urinated on the girl, and said "That's for 300 years of slavery..."? What in the hell is wrong with people?
January 30, 201511 yr Not good. It's come out that one of the jurors was raped 20 years ago and failed to disclose it. I'd imagine this is heading for a mis-trial and a subsequent retrial.
January 30, 201511 yr I hope both of these guys spend enough time behind bars to wear a nice comfy butt-groove into the stainless steel benches in their cells. However, it would seem that if UKMF's detail about one of the jurers failing to disclose being a rape victim is true, then this would logically end up in a mis-trial and have to go through proceedings again. I can only hope they are found just as guilty the second time around. Still, I think this is interesting thing to think about: Larry Mahoney - Drinks until he blacks out, gets behind the wheel of his pickup truck, attempts to drive home, crashes into a church bus, killing 24 teenagers and 3 adults in the fiery crash, and permanently scarring 12 more with disfiguring burns. Mahoney was convicted with second-degree manslaughter and a handful of other lesser charges, and sentenced to 16 years in prison with the possibility of parole after 8 years. He walked out of jail a free man after 10 years and 11 months, serving less than 6 months per person that he killed. Corey Batey - Drinks until he blacks out and together with a friend, rapes a 21 year old student at his college. Found just as guilty of rape as someone who is 100% sober. Faces a minimum sentence of 15 years in prison, with a possible 140 years in jail if given the maximum sentence on all three counts (one count of attempted aggravated rape and two counts of aggravated sexual battery).

I don't think that the fact that he was the victim's boyfriend, that he encouraged the assault, that he sent videos of the assault out to people in real time, that there's footage of them carrying a passed out girl into the dorm, or the way he presented his defense helped him-- at all. This looks like it's headed for a mistrial though. I do wonder how it was found out that a juror was raped 20 years ago though.
