Let me get this straight...they asked (because of a complaint), you consented, one officer thought he found some drugs, the other disagreed, and they left? Did they do anything wrong?

 

No they didn't do anything wrong...It just made me feel violated when I did nothing wrong.

BTW He found a seed from a shrub and acted like he found a ounce of weed.

 

So If a cop wants to search my car again I will not consent without a warrant.

For everyday citizen, I just don't think this is such a big deal. How many times have each of you been pulled over and asked if your car could be searched? It has never happened to me. I've been pulled over for speeding 3 times in my life and not once have my actions warranted being searched.

You know who it usually happens to? The kid driving around with loud pipes drawing attention to themselves or the guy whose car is always parked at a known drug dealer's house.

Only time my car was searched was when I was 16 and they found, and probably later drank, what they were looking for.

What about my scenario up in post #26? You're not concerned with people having their rights infringed upon like that? If I were living paycheck to paycheck, you can be damn sure I'd be mad to be held up an hour from clocking in at work.

That's your right but it seemed like you were insinuating they did something wrong. They were doing their job. They had a complaint, they answered it. They didn't just pick you out for no reason.

Not really. You can be arrested merely on suspicion.

...unless they use this Supreme Court ruling to set the precedent that the officer made a "mistake of law" and that they weren't being "unreasonable" when they assumed that they had enough to justify probable cause. Then they guy who had his car searched is up a creek.

Okay, you realize cops are human too? They make mistakes sometimes, so unless they're just harassing someone for the heck of it, it can't be helped sometimes. In your scenario, a flat tire can cost them everything you mentioned if their employer is that hard core. I would think a cell phone call explaining the situation would take care of all of that in most cases.

About 18 years ago I was arrested for DUI and the cop searched my car.He also asked my friend where's the coke at? The officer told my buddy that I said he had coke on him which was a huge lie. I ended up with a reckless driving charge and a speeding ticket. That was the most expensive two beers I've ever had.

I have common ground on both sides of debates when it comes to police.

 

What does drive me nuts a little is the same people never see anything wrong when it comes to cops.

 

If ignorance of law isn't an excuse for a common citizen it also should not be an excuse for a police officer. .

 

There isn't anything radical about that opinion.
