I can remember one year and one year only that Dale actually said his team should be considered for the national championship (2009).

With their district schedule, even if they played other national powers they still couldn't win the National Championship. Again, I think Dale just wants to be in the national conversation.

This Court does not understand Mr. Prosector's comments about the "consolation of the defense". The Court sees nothing in the record of any attempt by defense to console anyone.

 

This Court appreciates Prosecution's attempt to blur the issue. The issue with this Court is the need for adults to criticize a coach for his attempt to motivate his players, a technique that the facts show has proven to be highly successful. The Court notes that Coach Mueller has won 10 Kentucky football championships, more than any other coach in Kentucky history. Being a fan of "if it works, keep doing it", this Court finds Coach Mueller's motivational comments about his team's goal of being nationally ranked extremely effective in motivating his players.

 

This Court notes that Mr. Prosecutor is a fan of Raceland and hence and therefore lacks standing to criticize Highlands' coach, his comments, his motivational techniques, his hat, his dog or even the weeds in his yard. Furthermore, Mr. Prosecutor lacks standing to even criticize Coach Mueller for wearing black socks whilst wearing shorts and running shoes.

 

As to whether Highlands is a national power, this Court judicially notices the website Highlands Bluebirds - High School Football Program Information Website. That website states that Highlands has been nationally ranked in the top 25 football teams 8 times. Furthermore, in 2009 (the year Coach Mueller stated his team should be considered as the top team), a respected national ranking service ranked Highlands No. 3 in the country. This Court finds that Coach Mueller's comments were justified in light of such ranking.

 

As to whether some Highlands fans can consider themselves a "national power", this Court notes the rather arbitrary and unscientific manner in which national rankings are conducted. That having been said, 8 national rankings does demonstrate at least some support for such consideration.

 

With the prosecution having relied on comments made by Coach Mueller duing the 2009 season as the sole facts supporting the prosecution's argument, this Court questions why the prosecution is living so far in the past and reminds Mr. Prosecutor that this is 2012. This Court questions the prosecution's rationale and motivation for bringing up and relying on comments now made approximately 5 years ago. Much like this Court has previously stated that it knows pornography when it sees it, this Court likewise knows jealously and bitterness when it sees it. This Court will not sanction Mr. Prosecutor however as he suffers from an ailment known to be suffered by many others in this jurisdiction.

 

Decision for those defending Coach Mueller. This is a final, but non-appealable order.

 

This Court recommends that Mr. Prosecutor demand a refund for any tuition paid by him to obtain his on line law degree obtained from Fly By Night Law School. To the extent no tuition was paid, the conventional wisdom of "you get what you pay for" has once again been proven accurate.

Very true on that point. Just ask my clients; they wonder how they come up with me taking 3 hours to get a project completed and I come up with 5 hours.

I think Ram raises a valid point. However, determing high school football rankings at the national level is really more about political positioning than pure on-the-field performance. In politics, perception is reality. The same is true in mythical national football rankings. There are a whole lot of teams that finish the year ranked in some of the national polls who would probably not even have winning records if they played a schedule similar to what a team like Cincy St. X typically plays, or what Trinity played this past year, and yet they somehow get ranked in top-25 lists. How is that? They do this with some savvy scheduling, along with making use of their "name brand." These teams will schedule a couple of high-profile games against first-rate competition, and will then make sure to have some relatively easy games to fill out the rest of the schedule. If a team with an established "name brand" manages to win the one or two high-profile games and then breezes through the rest of the season undefeated, and can then capture a state title in the postseason, the chances are pretty good that at least one of the many polls will rank them at the end of the year. Highlands is fortunate to be a "name brand" team (at least to some extent), and so if Coach Mueller and Highlands are able to arrange the schedule nicely then HHS has a fighting chance to get a national ranking if they can run that table that year. Highlands is not alone in this... every year these various rankings are peppered with teams who get ranked using similar methods.

 

Also, I will go ahead and say this... if Highlands can have a good showing in its scrimmage against Trinity (which is definitely possible given that Trinity will have a brand new O-line this year and the HHS-Trinity scrimmage will be the first "real-game format" situation for T's new O-line), and if they can beat respectable KY teams like Boyle County, CovCath and Scott County, and beat Cincinnati Elder, and if they then go on to win Class 4A, I would not be surprised at all to see them crack a top-25 ranking at the end of the season in at least one of the polls.

The court failed to mention that Dale was named National Coach of the Year in 2009.

To be even considered or nominated for this coveted award the voters have to know who you are.

I think Dale has exploited Highlands nationally without biting of too much all at once and he keeps building the program each and every year.

Well, the two member jury jbwill and sweep seem to be in agreement that Highlands is a National Power and unable to say, "that school is too big".

 

Of course, the jury is full of members that are not smart of enough to get out of jury duty though. lol
