  1. You saw that in the questioning by the defense attorney in cross examination. Challenge is that a)the expert was clear that at most it was at most a couple of feet b)there was no squealing of the tires and c)Offc Tensing was not in a position to be dragged.
  2. Good question. Challenge seems to be that the prosecution's expert was so detailed and clear that unless someone proves he doctored the tape somehow I'm not sure how the next expert is going to be able to overcome what's already in the mind of the jurors. You could see the challenge just by the line of questioning by the defense attorney in cross examination. How much are you getting paid? Were you there? Did you go to the site? Red herring to get people to look away from the tape.
  3. That's their case. Self-defense because he feared for his life because he was being dragged. Problem is the video and the testimony of the expert. Defense attorney had a really tough job to try to discredit him. It didn't work. I am curious to see what defense he presents when defense takes over. He seems to have an uphill battle.

  5. In Ohio, murder is when someone purposefully causes the death of another. Voluntary manslaughter is done "under the sudden influence of passion" or killing without thinking.

  15. Defense first question asks how much he is being paid by the prosecutor. Expert says he doesn't know. Says it's "likely" more than $5,000 but really not sure. Next question asks is he went to the shooting site. Focusing on the fact that he wasn't there to see it live. Asks why he doesn't know how far Offc Tensing fell from the car. Latching onto the fact that the car did move forward a bit before the shot. Trying to get expert to agree that the car also was moving towards Offc Tensing i.e. to the left. Expert says if so it's immeasurable prior to the shot. Expert says steering wheel did not move to the left at the time of the shot. Battling over the "moving to the left" issue. Asks expert if he is qualified to say how far a car must move or how fast a car must move to cause Offc Tensing to fall. No. Defense attorney trying to raise questions about why Tensing's body angle changed right before the shot. Was he "spun around?" Expert says no way to tell that. Defense still trying to get the "going left" theory going. Expert still saying "no chance that happened." Defense: What if his arm was pinned? Expert: It wasn't. Defense: You weren't there, correct? Defense: You can't tell if the street was going uphill or downhill yet you can tell the jury what happened? Expert: Yes, I can. Defense is saying "Again, that's your opinion, correct" a lot. Defense: Why is Offc Tensing yelling "Stop?" Expert: As I said before, I don't know why he yelled stop. It would be speculation. I don't know why." Defense: I'm sure you don't. Judge didn't like that response. Expert: Tensing holding onto the car and him being on the ground definitely happened after the shot. Defense: Was he almost being run over? Expert: Very close. Defense: You can't say where the camera was for every shot. Expert: I can indeed. Defense: Did you examine the camera? Expert: No. Defense: You can't tell if it was functioning properly. Expert: I can due to metadata. It was functioning properly. Defense: No question the car was in motion when the shot was fired. Expert: Correct. After conferencing with Tensing defense decides no more questions. No re-direct.

  20. Expert says that even after the shot was fired the car moved AT MOST a few feet from where it was originally. I am anxious to hear the cross examination.
  21. Offc Tensing also testified that as he was being dragged his head dropped below the top of the door which only left him with a head shot. Expert says that's impossible based on the video.
  22. Video expert's testimony is not good for Tensing when compared to his testimony. Gun was out before the car was moving. He testified his arm was caught in the steering wheel. Video when broken down shows his arm was never near the wheel. It was on the seat belt. He also told investigators his head was inside the car. That is not shown.
  23. Not sure why you take offense to something that is pretty obvious.
