Jumper_Dad Posted July 21, 2016 Posted July 21, 2016 Georgians react after "upskirt" photography ruled technically legal Court: Shooting 'Upskirt' Videos Of Women Is Legal in Georgia's Public... Shooting cellphone video beneath a woman's skirt without her permission is legal in Georgia. That's the result of a recent ruling by the Georgia Court of Appeals. In a 6-3 ruling, the court sided with a man who openly admitted to sneaking "upskirt" videos of a woman while she was grocery shopping, arguing that the wording of state law doesn't make his actions illegal. In a case out of Perry, in central Georgia near Macon, Brandon Lee Gary was convicted of a single count of criminal invasion of privacy. He appealed the verdict, saying that his conduct didn't violate state law as it was written. Both sides in his case agreed to the facts. While working at a Publix grocery store in Houston County, Gary repeatedly aimed his cellphone camera underneath the skirt of a female customer and recorded video. Surveillance cameras at the store showed him doing so at least four times. A grand jury indicted Gary on a single count of "Unlawful Eavesdropping and Surveillance," and he was found guilty at a bench trial in Superior Court.
oldgrappler Posted July 21, 2016 Posted July 21, 2016 I think there should be an addendum to that law making it legal for the female or her relative to punch the photographer who does such a thing and take his camera from him.
Wireman Posted July 21, 2016 Posted July 21, 2016 Guess that's going to make for a longer trip to Hilton Head.
Getslow Posted July 21, 2016 Posted July 21, 2016 Was there seriously nothing better on the books to charge this guy with? What a mess this is. I can understand how the legislature overlooked this possibility when they wrote the thing, but yeesh.
Bluegrasscard Posted July 22, 2016 Posted July 22, 2016 With cases at SCOTUS dealing with every person in the nation the word 'intent' came up more than once. And the justices went with it (sadly). And in this care there is not a question of the 'intent' of the law and what the intent of the legislature was? Sorry Georgia court, if the big boys and girls in DC can play the intent game then you should have gone with it in this case.
hoops5 Posted July 24, 2016 Posted July 24, 2016 I think there should be an addendum to that law making it legal for the female or her relative to punch the photographer who does such a thing and take his camera from him. She should be able to kick him hard between the legs. But wait, it would not hurt because this spineless character does not have a pair.
