After seeing the video of Smith rear ending the shooter then driving away I don't think there is a sense of such an open and shut case now. At first I was like darn. Now I'm like yeah maybe he shouldn't have killed the guy but smith was not exactly being a choir boy either. I still want to really know why he shot Smiths wife.

He was likely reaching over her to get the gun out of the glove box and Hayes unloaded on him striking her as well.
April 14, 201610 yr If Hayes is able to leave the scene without shooting Smith, then I don't see how he can claim self defense. The details are crucial and how imminent the threat is will be a huge factor. In my mind if you have the opportunity to leave, then I don't buy self defense. That may not be what the law says but that is how I look at it. It is a dilemma though. The way the cars appear in the photo it looks like Hayes may not have been able to leave. There also is the issue that he could have been charged with leaving the scene of an accident and maybe that entered his mind. Even if it didn't enter his mind, I can see him claiming that he thought about it to bolster his self defense claim.
April 14, 201610 yr Hayes did call 911 before the shooting I think Smith went for the gun and then got shot. All over Smith doing a hit and run.

I don't know, I've never been to New Orleans. There are still to many unsolved issues still imo to condemn Hayes completely at this point. Question I do have is what Smiths two buddies in the back seat do when this occurred?

If someone is dead how can you be charged with attempted manslaughter, shouldn't manslaughter alone be the charge? *Nevermind, I went back and read the article, didn't initially realize that there were two victims.
