High School Coaches Banning Players From Twitter

Featured Replies

Just because you have the freedom to say what you want doesn't mean you are free from the consequences of speaking.

AGREED!!

So, are lifeguards taking away your rights when they tell you not to go in the ocean because it's unsafe? No, they are trying to protect you from dangers that you don't know about.

I think that what good coaches do, try to protect players from the dangers of social media. We've all seen people make huge mistakes on social media, some so big it has changed the course of their lives. Teenagers for sure don't have a clue about dangers that adults face every day with their decisions.

If you had a small child, would you let him touch a hot stove, or make a rule that they don't need to be around it?

Part of me thinks you're joking here. Maybe having some fun toying with folks? Because this argument makes absolutely no sense. Would you like me to apply your logic in other ways so you can see this? I just want you to think about it before I do because it would make your argument sound very very silly. Let me know.

I am trying to clarify how private schools fit into the KHSAA?

Direct from the KHSAA...

The Kentucky High School Athletic Association (KHSAA) is a private, nonprofit organization designated by the Kentucky Board of Education to manage interscholastic high school sports in the state. In almost all states, an organization that is not formally part of state government manages high school athletics. Practices vary as to whether the organization manages activities other than sports and whether middle schools are covered.

That's right, I forgot, the Diocese buries its head in the sand when it comes to athletics.

Then Private schools need their own separate post season tournaments. As long as they are playing with the Government schools under control of the KHSAA they are part of a government entity.

So many coaches crack me up. They worry about what they can't control. Maybe instead of some coaches being half Gestapo and half Social Worker they should concentrate on coaching the team to the best of their ability and let the chips fall where they may.

Dude you are all over the board today...I'm not even sure which argument to pick up, but I'm certainly sure that you don't believe everything you are dishing out....

It's been a good read, but seriously, you have coached, and I'm sure you had your share of incidents and I'm sure you had at least some team rules....that's the way sports work in high school.

Has nothing to do with public or private or whose head is in what sand or which orifice....

So if a kid gets a DUI during the season, he should not be punished by the coach?

No, a HS coach shouldn't punish a HS kid for a DUI. The punishment comes from his parents and court system. C'mon people this is high school sports for goodness sake. These kids are not being provided money, a college scholarship, etc.

I'm sure glad that you all weren't my coach or my kids coach in HS basketball.

Private schools fit in that they voluntarily participate. They are not obligated to. We are obligated to participate in government. We HAVE to pay taxes or we go to jail. Private schools don't have to participate in KHSAA. So they fit in that they voluntarily join and agree to abide by their rules, right? If I start a private school, I can create teams and play other teams without jurisdiction of KHSAA. I would be largely unsuccessful in this endeavor, but I could do it.

Who designates the KHSAA? It is in the above but you failed to bold it.

And to be clear:

About the KHSAA

The Kentucky High School Athletic Association was organized in 1917 and is the agency designated by the Kentucky Department of Education to manage high school athletics in the Commonwealth. The Association is a voluntary nonprofit 501©3 organization made up of 280 member schools both public and private. The KHSAA sanctions 40 state championships in 12 sports and 4 sport activities, licenses and trains over 4,000 officials, provides catastrophic insurance for its more than 70,000 member school student-athletes, as well as overseeing coaching education and sports safety programs.

He should if it says the kids will be punished in the handbook or the school by-laws. If it's a public school, the school board gets to decide and/or interpret existing laws. And they CAN punish for DUI's.

Private schools can do whatever their handbook says, and I imagine every handbook in private schools has a clause about DUI's. So coaches would have to follow the rules. Administrators would have to follow the rules. Right?

In this example is Covington Catholic voluntarily participating in the KHSAA?

Correct, the state has designated management to it, with limited authority. They do not fund it. This is very common in states, in many different levels. They sub out agencies and watchdogs for tasks with limited authority. It's a sub-contractor and very clearly stated so. Sub-contractors do not represent the agency that hired them. Clear precedents establish this. If KHSAA employee does something wrong, government is not sued. Private entity, KHSAA, is sued.

It's becoming more popular to have "morals" agreements when players participate in extra curricular activities. They are representing the school and the school has a brand to protect, much like an at will employee.

While I don't necessarily agree, I understand.

Yes. They could make the decision to not participate in KHSAA events and play independently. It would not be a good one, but they are not held captive to the alternative.

So the KHSAA's Creator is the Government, correct?

So the KHSAA's Creator is the Government, correct?

No. See below...

The Kentucky High School Athletic Association was organized in April, 1917. Charter members were Frankfort Boys’ High of Louisville, Owensboro, Carrollton, Lexington, Carlisle, Anderson County, Monticello, Somerset, Ashland, Stanford, Paris, LaGrange, Morganfield, Danville, Clark County, Covington and Cynthiana.

The organization was around before the state government sub-contracted its services. It is clearly stated as a PRIVATE, non-profit. You cannot be private and governmental. Government is public - publicly funded, publicly voted on, publicly determined. That's how the law sees it. Trust me.
