If you believe abortion should be illegal, what is the penalty?

Featured Replies

Clyde brought it up in the other thread. Pro-Life supporters often say abortion is murder. So are you willing to allow the same punishment as murder? Also, don't forget, regardless of your opinions on the death penalty it is still on the table for punishment in most states.

I believe they should go through the same legal process as any other person charged with murder.

This is a question many will remember me posing several times on here. It's the reason IMO that we will never see abortion outlawed. The public as a whole will not support any form of punishment that is the equivalent of a murder charge.

You cannot be against abortion if you are not for the death penalty for the mother who gets an abortion.

First off. I applaud you for sticking to it. I don't think every pro-lifer would do the same.

1. Just to make sure, if its a state where the death penalty is allowed then it would be on the table too?

2. Man gets a woman pregnant. They split the cost of abortion. Man is an accomplice, right?

3. Doctors who perform the abortion are also on the hook for murder?

I agree and especially think that your last statement is true. And while I'm positively pro-choice (therefore it shouldn't be surprising), I still don't in any remotely way view the people I know who've gotten an abortion as murderers. But I'm assuming IF the pro-lifers know someone who has gotten an abortion, that person is a murderer in their eyes...

Yes to all three questions.

I don't differentiate life inside the womb from life outside the womb.

If Roe is ever overturned, should abortion be handled by the states or the federal government?

States IMO....I think it's an issue that can and should be handled on a state by state basis.

Feds, but if states is all I can get, states is what I will take.

Technically, wouldn't it be the doctor who would be first charged? After all, they are the ones actually doing the deed itself. The mother would be then either be an accomplice or a conspirator.

Do you want to put a mother in jail like you would an accomplice to murder? The mother hired a hitman, right?

If Roe is overturned, then it will simply mean a revision in interpretation in certain rights. Simply because something isn't a right, doesn't mean it is therefore criminal. So if the federal government wanted to enforce criminal penalties for killing an unborn child, they'd have to create them. I don't think that will happen. That will mean it's up to states to enforce under their own criminal codes. I find it highly unlikely that if the Court steps in and overturns that decision that the feds will suddenly come in and make this a nationwide federal offense... and I can't imagine that the conservatives on this board would appreciate MASSIVE Congressional overreach on that scale... right?

That's what I'm getting at. If Roe is overturned new laws would need to be put in place to clarify its legality. I imagine there would be a push to have it banned at the federal level, but this would seem to conflict with the states' rights philosophy typically shared by those against abortion.

I had this question posed to me by Clyde. I put some thought into it but never got around to writing down an answer. My thoughts are generally along the lines of Randy's...they people involved directly with the abortion should go through the same type of legal process as any other murder.

As with all situations where one person ends another's life, I think the consequences should vary, as they would in any murder case. There are degrees of manslaughter and degrees of murder in most states, if not all. I could see where these types of things could apply to different situations regarding abortions. For example, I wouldn't charge a woman who was raped and conceived a child (estimated at approximately 32,000 occurrences a year in the US) the same way as I would charge a married mother of two who decided she didn't want any more children, so when she got pregnant decided to have an abortion. I don't feel like there are necessarily as many varied charges as there are in a conventional manslaughter/murder situation, but I think there is a degree of separation from one to the other.

I understand what you're saying. It would seem that the enforcement would need to be on a state level from the explanations that you and Getslow have given. Honest question, though: is murder banned on a federal level?
