Who gets to define "terrorist" and why couldn't they simply define it to be all Muslims in America? And why does that exempt the government from following its own laws and constitutional safeguards? We have also mistakenly detained and interrogated innocent people indefinitely before because we have operated this regime outside of these safeguards where those in charge get to make up their own definitions.

Dude, you would honestly torture terrorist SUSPECTS even if it doesn't provide valuable intelligence? I have a hard time believing that. Julian Assange is considered an enemy of the state and a terrorist, would you torture him?

What I'm getting at is that if we say it's OK to operate outside of our own laws so long as it is against "terrorists," and the people who get to do this also get to define what a terrorist is (and that is not a self-evident definition), then where does the line get drawn? What would prevent abuse (like in my hypothetical)?

They don't wear uniforms like a typical soldier. Most will not confess to be a terrorist. We have seen numerous times that intelligence is not 100% accurate. Just because an Arab is armed does not mean he is a terrorist. Arabs have a right to defend their homes just like American's in my opinion.

You're right, Arabs have a right to defend their homes, but Arabs aren't the only terrorists. Hans Gruber was a terrorist and he wasn't an Arab. If McClain hadn't been so dang trigger happy, we could've water-boarded him too.

Do you consider Self Defense immoral? In some cases, war is self defense on a national level, ie the United States declaring war on the Empire of Japan after Pear Harbor and then declaring war on Nazi Germany after Nazi Germany declared war on the US.
