August 16, 201214 yr Someone correct me if I'm wrong, but even if the police found that race was a factor in why the kids did what they did, this still wouldn't be a hate crime. Ohio's "ethnic intimidation" law applies an additional degree of severity to the underlying offense, but the way I'm reading this, it seems like it only applies to specific crimes: ORC 2927.12 "(A) No person shall violate section 2903.21, 2903.22, 2909.06, or 2909.07, or division (A)(3), (4), or (5) of section 2917.21 of the Revised Code by reason of the race, color, religion, or national origin of another person or group of persons. (B) Whoever violates this section is guilty of ethnic intimidation. Ethnic intimidation is an offense of the next higher degree than the offense the commission of which is a necessary element of ethnic intimidation." The five numbered offenses there are aggravated menacing, menacing, criminal damaging or endangering, criminal mischief, and telecommunications harassment. According to that article, the boys face charges of assault and aggravated riot, neither of which seems to be included in the hate crime statute.
August 16, 201214 yr What irks me is the boys showed no remorse for what they did, heck hold the parents accountable and put kids in foster home until the parents can control them. Can the guy sue the parents since the kids are underage?

I don't even have to say anything that may make things worse.
August 16, 201214 yr 6 black kids beat a white man and they will not be charged with a hate crime. This is outrageous. If it were 6 white kids who beat up a black guy they'd be charged with a hate crime. They would already be under the jail and the revs would be everywhere. The black kids said they were bored and that's why they did it. These little ignorant kids need to be locked up forever. Society has no use for them. I hope they get what is going to come to them one day. Try that in Kentucky. Police: Man attacked because teens 'were just bored' | Cincinnati.com | cincinnati.com You are new to BGP so you may not have seen me say it on here before but until we can all stop looking at race as a reason or a cause for behavior then we'll never advance as a united country. What these boys did was stupid and inexcusable but they said all the right things to the cops for this to not be seen as a hate crime. Just because six black kids beat up a white guy doesn't make it a hate crime. In situations of actual hate crimes that pit a white person perpetrating a hate crime on a black person there is always evidence that the crime was racially motivated. That evidence doesn't exist in this situation. Getslow brought it home for everybody. I hope you take note. Looks like mountainref may have a skating partner.

August 17, 201214 yr A crime is a crime. If someone murders another person, it doesn't matter to me what motivated them to do it. Murder is a crime. End of story. Why does there need to be additional legislation depending on the supposed motivation? Does it change anyone's view of the act? Does it make you feel a little better about this random beatdown that it was just a case of boredom, or would you feel a little better if they were racists? In America, it seems we believe that we can legislate away everything we don't like. This statement applies to much more than just this example. Again, if we simply enforced and upheld the laws that are/were already in place to protect our citizens, there should be no need for these additions.

August 17, 201214 yr A crime is a crime. I'm sure they're all unique and different in some way. It doesn't require an additional piece of legislation. Punish them for the crime. A judge and jury can hear the details (like what motivated the act) and determine a proper punishment. Hate crime laws are unnecessary when enforcing the laws we already have would suffice. What if Timothy McVeigh had just been bored? Should his punishment have been different? Or, had he blown up the building because he hated black people and one worked there, should it have been different?
August 18, 201214 yr What evidence do you have that their families are on government assistance? Zero, I'm profiling based on race, area in which crime took place, & the fact that not one father was mentioned in any of the news stories. Is my methodology wrong????? Could I be wrong? Sure and I will be more than happy to apologize for my statement. However, when was the last time time a group of black youths raised by both a mom and dad in the same home acted in such a way?

According to your logic it shouldn't be safe for anyone to go outside because there is a very significant number of black youths raised in single parent homes. Don't let the stupid actions of a few characterize us all. It's not fair to the rest of us.

If you heard what some of the folks who live in this neighborhood are saying.....they ARE afraid to go outside. Doesn't matter, Black or White, when you are raised by the streets nothing good will come of the situation. I am in no way characterizing all because you are right, it wouldn't be fair.
August 18, 201214 yr I'm bored, does anyone want to go with me to beat up someone, it's ok, the law doesn't apply to boredom crimes.

It perpetuates racism and as long as laws like this exists, we are not going to advance as you would like. How can you expect to get rid of racism if our laws separate people based on race?
