Here is the provision in the EPSB's guidance:

What you might be confusing is if there is an issue of child abuse/endangerment.  A teacher/principal would have to report as mandated reporters, but from what I've read of this case it was different as the student had already graduated and was no longer a minor as the incident happened several years previous.  No child was under immediate harm.  So the issue was that there needed to be a report to the EPSB about the teacher being investigated for a criminal act, which would fall under the fourth bullet here.  Based on the other articles, the first could also be invoked because the teacher resigned immediately after the interview with law enforcement.

When it comes to the issue of licensure, a teacher or principal has no role in that process because again, those things go through human resources that neither has supervisory authority over.  The reason the superintendent needed to report was so that this teacher would have it flagged on their credential and so that they could have it suspended or taken away after due process.  That would prevent them from simply moving to another district, repeating the behavior, and putting other children at risk.  This is why Stacy had his credential taken away for a failure to report.

This whole situation is shockingly disappointing and in retrospect just shows the ultimate in bad judgement.  No where do we see the board attorney taking any responsibility, hard to believe the Supt. did not seek their guidance.  If not….bad judgement.  Did the Supt. not have a thorough discussion with the principal to fill in the gaps of the interview and discuss their professional reporting responsibility.  If not…bad judgement.  Did not the Supt., principal, and attorney take the full board into executive session and break down the entire scenario and fully discuss their reporting responsibility which was blatantly obvious in this case.  If not… bad judgement.  And, it appears to me the EPSB came to that same conclusion.  Such bad judgement that it does not ever warrant the risk of a repeat.  Thus no recertification of credentials.
