It doesn't matter what the age difference is. If you have nude pics of an underage child you are breaking the law, regardless of your age.

 

If you are 14 and you have nude pics of your 14 year old girl friend you are breaking the law and can be charged with child porn.

I believe if you send pics of yourself and you are underage you can be charged (I could be wrong on this one).

This is just insane I'm guessing a lot of parents would be surprised how many of their kids would be charged under this. So a HS couple can have sex but not send photos ?

Technically and legally it is statutory rape when an underage couple has sex. It isn’t normally prosecuted though.

Because the courts we be arresting more than half the HS students in America. The same can be said for the law about photos with a majority of kids having smart phones today. I just wouldn't want to ruin a kids life is what I'm getting at over this.

 

If the kid is doing something malicious that is something totally different.

Some of the charges have already been dismissed...
