I'm not sure based on the info at hand. I don't like the fact that they took pictures and made a joke out of it. BUT, with that said I don't think they were poking fun at a death but rather someone who they thought was passed out (much like someone who had too much to drink). I don't think they realized the severity of the situation and likely assumed he was just "nodded out".

 

That definitely complicates things. The family is devastated I get that, and the circumstances surrounding the pictures and the behavior of the others is enough for the family to want heads to roll. I definitely get that. BUT, with that said they cannot blame others for their sons actions that night and since they were not there they cannot accuse the others of killing their son unless they know beyond a shadow of a doubt they forced him to do it against his will (in which I doubt).

So if a group of two or three people go out partying one night and one of them happens to OD the other two should get in trouble because they were partying with him that night? Even if the deceased supplied their own drugs?

 

I get what you are saying with your post and I understand where you are coming from. But there's a lot of grey area there. I understand manslaughter and a lot of circumstances fit into that category, but when you're dealing with drugs it gets tricky IMO. Everyone should be responsible for what they put into their own bodies unless they were unjustly compromised .

What if someone has their own dope, own needle, and everything else they need. What if they do the entire process themselves but ask someone else to help them out with the injection? Clearly the intent is to do the drugs regardless of what the other person's doing. I get from a law standpoint it doesn't matter, but like I said these things get tricky. Some people have phobia's and cannot get past the idea of putting a needle in their arm. I could see where someone like that would get someone else to do it.

But its not the same no matter how much you want to believe it is. Millions of people a day shoot it without dying, you put a gun in your mouth and pull the trigger you're dying every time. Yes unfortunately people die from heroin but you are equating it to a situation that is "instant death" and that's just not the case. Apples to Oranges IMO.

Nope, people play Russian Roulette for the thrill, excitement and high they get from it, much more similar than you'd think. And no they don't die every time, it's a game of chance just like taking heroin.

What if you didn't want to shoot yourself in the head so you asked a friend to do it?

 

Two different things but for argument's sake that would be me setting my friend up for murder.

I've seen users many times try to slip something to their "Straight Friends" either in their drinks or in one case a milk shake just to watch the non user get high for the first time as a joke...so yeah they do give it away sometimes. If they are also selling they'll often give it away to begin with.

 

Saw a guy on TV talking about how a friend slipped Meth in his coffee, he then spent the next 2 years buying all the meth the friend could get for him.

He wasn't in denial, he was talking about how quickly he became addicted and then spent the next two years chasing that same high again. He fully admitted to being addicted, but said the first time he took meth he had no idea.

Taking/supplying Drugs is a crime.

 

If someone dies during the commission of a crime that in of itself is also a crime even if it normally would not be a crime.

 

Example: You rob a bank and the guard has a heart attack during the robbery and dies, you get charged with his death.
