May 19, 201313 yr What is the case when a couple gets pregnant and the man makes it very clear he wants the baby, but the woman has an abortion despite the fathers wishes? Murder??? Good Question GT, we all seem to be used to the ol' double standard. But in the case of abortions the double standard has been legislated in. Not saying that is right or wrong, but there is a legal double standard in place.
May 20, 201313 yr Why murder? The federal Unborn Victims of Violence Act of 2004 defines "unborn child" as "a member of the species homo sapiens, at any stage of development, who is carried in the womb." If someone kills an unborn child while committing a federal crime, it's considered murder, said Tampa lawyer Todd Foster, a former assistant U.S. Attorney and FBI agent who is not associated with this case. Welden's first alleged crime? Product tampering, "with reckless disregard for the risk that another person would be placed in danger of death or bodily injury." So under federal law, since abortion is not a federal crime, a woman getting an abortion would not be committing murder.
