I posted on this in another thread a month or two back. I think it is a good solution that other states will soon follow. It should get the transfer issue out of the courts and simplify things.

 

I have not seen the final version of the rule. Are there exceptions built in for kids moving a certain distance, etc.?

I read there are still exceptions that would allow for immediate play but those have been reduced.

Will it reduce cases where kids, who are ruled ineligible, decide to take the issue to court for a temporary injunction? I'm not so sure.

 

On the one hand, you may look at it and think more folks will accept the 50% rule, knowing that the kid can still practice and will be eligible for the 2nd half of the season and more importantly, the playoffs.

 

On the other hand, it may cause more people to challenge the rulings. As a parent I may conclude that it is best to seek a temporary injunction, which allows the kid to participate pending court outcome. The reason being now that injunction only has to last 1/2 the season (5 weeks in football) before it becomes moot. If I think the court process will take longer than that, I may be much more likely to take that route as a way for my kid to play the entire season.

So football season starts team appears to be in for a bad season (Injury to star player for example or unrealistic expectations), could kid transfer to cross town school (during the season) sit out 5 games and be ready to play by the end of the football season? This could be a mess if that's allowed.

Yes, IMO it will reduce, if not eliminate the court issue - and that is THE problem with transfer rules and why enforcement has come to a virtual halt.

 

The main argument that led to injuunctions was a kid possibly missing an entire year. The injunction is issued to prevent that from happening. With this rule, they can no longer say the kid could miss an entire year. I don't think courts will issue injunctions knowing that the kid will get half a season. I think some families will not go through the time and expense. They will take their half season and move on.

I am sure someone will test it. How the courts handle that first case or two will be critical. If no injunctions are issued, states will bandwagon the rule as soon as they can.
