Who the heck does state Sen. Julie Denton think she is?

Does anybody know how to impeach a state senator? Its time for BGP to become a political action group!

I have a child with a disability and it is pathetic how little of the appropriated funds go for therapy and care services compared to the overhead of the provider agency.

It may not be an option for you, nit of the need arises, you should check out the Home of the Innocents here in Louisville. Not only is it a top-notch facility, the community support for it is unreal.

What happens if the loser is a poor family whose crippled matriarch has been abused in one of Kentucky's 40% of sub-par nursing homes, but can't afford an attorney to challenge the nursing home's hot-shot lawyer...especially when now they have to go through a sub-hearing phase, as required by SB 9?

You hope that you can get approved to move them to a new home, and that the new home doesn't have the same problems. I know this personally.

I'm don't want a person to place blame on. I want a solution. This legislation is not a solution.

Agree.

I wrote to my senator, Chris McDaniel, asking for details on the vote. He was quoted in this article as saying "the bill will strengthen the case of plaintiffs who have legitimate complaints against nursing homes". He apparently has a positive take on things, so I told him that I'd like to see what that take is, and why the voting for the bill needed to be conducted in such a crooked-appearing fashion.

Let's see what he's got to say about it...if anything at all

I got an email from Senator McDaniel on Saturday morning, and he said that a proper discussion will require more than an email. We've got a conference call scheduled for tomorrow at 12:30. Should be interesting.

CWB, you are a man of action, look forward to your report on this conference call.

Oh, my apologies...I ended up having some word stuff come up that I couldn't reschedule. We're working on another time to discuss. However, he's actually working on getting Senator Denton in on the conversation as well. I'll keep you folks filled in.

Medicare paid $5.1 billion for poor nursing home care:

Medicare paid $5.1B for poor nursing home care - Yahoo! News

Investigators estimate that in one out of five stays, patients' health problems weren't addressed in the care plans, falling far short of government directives. For example, one home made no plans to monitor a patient's use of two anti-psychotic drugs and one depression medication, even though the drugs could have serious side effects.

In other cases, residents got therapy they didn't need, which the report said was in the nursing homes' financial interest because they would be reimbursed at a higher rate by Medicare.

Any luck with the phone interview?

Not yet. Thus far we've managed a month-long discourse of conflicting dates and times to try to talk. He's both running a commercial concrete company and being a state senator, and I'm fairly busy with work, so we keep running into conflicts. I emailed him on Saturday, though, so hopefully we can get a time worked out here soon.

Cool, keep us posted.

For what it's worth, SB9 was defeated yesterday in the House.

I heard that. I believe we're going to be talking on Tuesday next week.

I never ended up giving the synopsis of the conversation I had with Senator McDaniel about this. To his credit, he was the one who insisted on making our phonecall happen. However, the gist of the conversation was essentially, "We'll have to agree to disagree". His feeling was that this piece of legislature originally cited in the thread was one that would allow nursing homes the ability to better serve their residents. I asked how that could possibly be the case, and his response was that the medical review panels would allow them to keep more money out of their own legal defense and put it into their efforts to care for patients. I asked him if he truly felt that a for-profit facility would be operating that way, and he more or less said, "yes". When I asked about the shameful way in which Senator Denton conducted the proceedings, he did acknowledge that it was not exactly fair, but that he was not the chairperson.
