I think it would be illegal to film underage kids wouldn't it? I bet if the police got their hands on that camera and there were a bunch of upskirt (cheerleaders) or backsides (volleyball), etc. that it would have to be illegal. Or am I wrong?

That's not accurate - I think he could/should have been charged with voyeurism, which is a misdemeanor. And when there is photography/videotaping involved, and minors involved, it gets bumped up to a felony. Public place or not, you cannot record/photograph any portion of an individual's body that has a reasonable expectation of privacy, whether it's covered in clothing or not. There was also no consent, he was surreptitiously recording them, and they were minors. The "public place" shield doesn't allow one to break that many codes.

I am with you on this. A few years ago a man was arrested for taking pictures from underneath the bleachers at basketball games at a school near me.

What was he taking pictures of? How the plays were developing?

I was under the impression that a picture of the guy was taken by a parent at the game.....

 

Perhaps I am incorrect, however, I thought the coach notified the 'team photograhper' about the situation and they did get a picture of the guy before the coach confronted him in the stands about what was going on.

 

Either way, good job by the coach of noticing this idiot. I wish the coach would have told me before confronting the guy. I'm sure I could have talked, err, beat some sense into this guy and not allow him to leave with the camera.
