September 4, 200917 yr Author Sorry, but without a big payday, I would not be willing to give away any of my organs, except to a family member. If that makes me a jerk, so be it. That being said I'm not sure that I would be willing to sell any organs either. I said some...not all. Personally I'm not for sure where I fall. As of right now I'm currently an organ donor (though, I admit the motive of profit isn't currently there for me). I do know however that a great many of my family members and friends already do charitable work, are organ donors, and would stay donors and not sellers. Would there be enough organs to satisfy everyone? No, but right now there already isn't enough. But on the flip side...if people could make a profit then there would possibly (my hunch is for sure) be added organs into the overall organ bank and maybe that would help more donated organs go to the poor and/or needy.
September 4, 200917 yr Lots of people are organ donors, its one thing to donate an organ that you no longer need. Quite another to sell one for profits that you intend to be around to enjoy.
September 4, 200917 yr Another caveat to the discussion would be that suppose you are able to sell the organs of your spouse, etc. rather than simply give them to an organ donor program. 20/20, Primetime, etc. are full of stories of people killing their spouses for life insurance, etc. This could just be another potential motive for murder.

It is my understanding that you can already choose to donate an organ to a family member.

I was thinking about the first part as well. Many are donors now but how many would change that to sellers (after dead) to benefit their spouse or childern?

September 4, 200917 yr Unless you've got 7000 kidneys you're not going to be the high-volume low-cost provider, right? Your limited # of kidneys would lead you to sell it to the highest bidder. September 4, 200917 yr Let me toss these things out that are current status of the law and it can then be discussed: Your corneas may currently be taken upon your death, with or without you or your family's consent, and used for whatever purpose. Many donated organs are not used for transplant, but are used for medical research, and companies make large amounts of money off the R&D discoveries using your organs. Should you be able to share in the royalties? Should disclosure of that fact be an ethical requirement? There are accusations that some hospitals and physicians fail to revive questionable patients who arrive in emergency rooms because they are organ donors with an immediately available organ. In short, the accusation is that the doc lets you die in order to harvest you. If you have designated yourself as a donor, does your health care surrogate have the right to subsequently overrule you? If you have not specified whether or not you are a donor, does the hospital/doc have the right to harvest you? If we can donate blood and sperm for money, why not kidneys, etc.? Should donations be able to be designated, as opposed to placed upon a list? In other words, can I state that my organ donation is restricted to RM, bugatti, Watusi, because they are Mods, but don't give it to Clyde, because he's a liberal rabble-rouser? Discuss amongst yourselves.

You can't say insurance would cover it if there are no organs to be had for the poor. So what are the poor to do? Is there an analogous situation?

Heck, U.S. private donations are more than all but 4 or 5 of the world's governments foreign aid. Anyways, IMO laws pertaining to individual rights should be based on their constitutionality, NOT "how it effects the poor."
