He's not getting charged with shooting the gun, he's getting charged with carrying a gun without a concealed carry license. You honestly think that crime deserves 3.5 years in prison if convicted?

Not too harsh a sentence for him, he's no different than anyone else. It's too harsh of a sentence for anyone. Not sure how anyone could disagree. Do you agree with mandatory sentencing?

How is there a double standard?! It's the same mandatory sentence for everyone convicted of committing the same crime. That's actually one of the major pluses about mandatory sentencing - it takes subjective evaluations about race, wealth, sex, religion, background, etc. out of the equation. You want to argue that 3 1/2 years is too strong a sentence, period? Fine. But he's not being treated any differently than if Halfback20 did the exact same thing. No double standard.

 

I have read some stats about this law.

 

50% of the people charged with this crime plea down to a misdemeanor.

 

10% of the cases that go to court actually get convictions.

 

Anyways, about the mandatory sentencing.

 

I'd rather get a fair sentence, than an equal sentence. All circumstances are not the same and should not be treated that way. Someone carrying a weapon for self defense should not be treated the same as someone who planned on using it to murder another person. (Not saying Plaxico falls in either category because I do not know his intentions)

So tell us - what is a fair sentence? And, just for fun, let's pretend this is such a "regular" punk and not a New York Giant. And should that fact that it occurred in NYC rather than Des Moines, Iowa have any effect on the sentence? (Because it obviously does and the state of NY obviously wants it this was so as to encourage people not to commit this crime.)

 

I have said before that I disagree with mandatory sentencing in general and not just for this specific case. I think it should be determined case by case. Every situation is different and it does not matter if it's Joe Buck or Michael Irvin, the crime doesn't fit the punishment in regards to this law.

 

I'm not sure what a fair sentence would be. You can not give a fair sentence in general considering all cases might be slightly different. You can give an equal sentence, which is what mandatory sentencing does.

Nope. I make the same evaluations and opinions of him based on the same stories and news about his actions and behavior that everyone else reads. Maybe he's just a sweetheart of a guy, but I'm thinking I'd prefer he not live next door to me.

The same media that most people claim has an extreme bias when it comes to reporting the "facts"? You do know that "when it bleeds, it leads". They are not going to report the good that Plaxico does. I have read some quotes from his teammates, whom you would think might be upset with him after something like this. However, they still stand behind him and talk about how he has been a really great teammate to them and that they just wish him the best.

 

I do not know Plaxico. I do not know whether he is truly a good or bad person. But I do not claim to know whether or not he is a "punk" or a "thug" based on what I read in the news either.

And, BTW, there have also been several of his teammates that have not supported Plexithug's actions and behavior.
