He's not guilty (yet) because we all enjoy the same rights. That's one of the many things that makes our country the best in the world.

 

If he is guilty (which I think he is), then the courts will sentence & punish him appropriately.

Yes, he does have that right. This case will be over by next football season though. So if you're saying he will be in the NFL somewhere, you're essentially saying you think he is, or will be found, innocent.

Do you think his right to a fair trial was hurt at all by the mayor of New York city publicly claiming that he should be prosecuted to the fullest extent of the law?

We all know Halfback is a big time NYG homer, but he is dead on in this case. No way should he get 3.5 years for something like this, especially if he is a 1st time offender. People do far worse and get way less. Lets just say Plex isn't a big time athlete with a shaky charecter back ground, not criminal. Are you saying anyone with no criminal background should get 3.5 years for carring around a gun. Double Standards.

Nope. I make the same evaluations and opinions of him based on the same stories and news about his actions and behavior that everyone else reads. Maybe he's just a sweetheart of a guy, but I'm thinking I'd prefer he not live next door to me.

How is there a double standard?! It's the same mandatory sentence for everyone convicted of committing the same crime. That's actually one of the major pluses about mandatory sentencing - it takes subjective evaluations about race, wealth, sex, religion, background, etc. out of the equation. You want to argue that 3 1/2 years is too strong a sentence, period? Fine. But he's not being treated any differently than if Halfback20 did the exact same thing. No double standard.

So tell us - what is a fair sentence? And, just for fun, let's pretend this is such a "regular" punk and not a New York Giant. And should that fact that it occurred in NYC rather than Des Moines, Iowa have any effect on the sentence? (Because it obviously does and the state of NY obviously wants it this was so as to encourage people not to commit this crime.)

Well, I would assume that part of the equation which people considered prior to voting included whether: 1) they thought he was guilty of the crime - irrespective of any presumption of innocence; 2) what type of sentence he would receive if convicted; and 3) how the NFL will respond to his actions. I don't think it's fair to claim that someone has forsaken the values of our criminal justice system simply by expressing an opinion that what they think might happen to him is that he'll be found guilty and be sentenced to jail time and therefore miss the season. This is, after all, a forum to express opinions.
