WSAZ News is now reporting that the assault charge against Mr. Cruz for passing gas on the officer has been dropped.I guess the prosecuters and the officer "aired" out their differences. I will provide the same link with the update....... UPDATE: Thursday @ 11:04am Kanawha County Magistrate Court reports that the "battery on an officer" charge against Jose Cruz has been dropped. Magistrate Jack Pauley says an assistant prosecutor came to the office and requested that charge be dropped.
