August 23, 200719 yr Author First, I would be willing to bet that the school had nothing to do with sending that information. Second, I think that the situation, as you descibed it, was illegal recruiting. Third, you are right, it may not be possible to identify the sender in this case. Fourth, my guess is getting an anonymous mailer dodn't do much good in getting the student to attend the school. In fact, it sounds like it triggered a KHSAA investigation. Sounds like the system worked. That is how the situation was described to me from a KHSAA person. On your first point with this thread being bylaw 10 being unenforceable, it does not matter whether it was the school that sent it or not. A comment from a KHSAA person was made to me that they believed a large private school was conducting illegal recruiting and fudging on scholarships but could not prove it. As with police, sometimes what you know to be a fact and what you can prove is two different things. And that is not limited to just privates. For everyone that the system works, it begs the question of how many times did it not? A question, I don't think can be answered.
August 23, 200719 yr And that is not limited to just privates. . And I think that not enough people understand or some people just refuse to understand that.

If so, then they have a duty and responsibility to report this supposed allegation on the record and get it on the record. Let the chips fall where they may and if a school is really doing this then nail them. If the recuiting is that blatent and there is actual money flowing then this should not be difficult for even the KHSAA to determine. But instead, they spread rumors, create distrust and spread resentfulness throughout the state. Quite simply, this is official reckless irresponsibility.

It was reported. It was investigated and while they believed it was going on, there was no paperwork to prove it. I am sure any police officer will tell you that there are people that they know are committing crimes but they cannot prove it for a court of law. But they know what is going on, just can't prove it.

I am sure any police officer will tell you that there are people that they know are committing crimes but they cannot prove it for a court of law. But they know what is going on, just can't prove it. How on God's green earth could they conclude that they thought some thing was going on with no proof to prove it? That is a terrible thing for any one, particularly some one affiliated with the KHSAA, to say. As for the police, thank goodness that they can't take action when they only think something is going on with zero proof. Either there is proof or there is not, and if there is not, then they shouldn't think something is going on. I hope like heck our Maker doesn't judge us that way. We as humans refuse to accept our own shortcomings and instead based our failures on the alleged wrong doings of other people. If a student leaves our school, its not because our school is doing poorly or the other school is better, its because the other school cheated. That sickens me and unfortunately that line of thinking is alive and well in high school athletics in Ky. The number of times I've heard people make false, reckless accusations against people with no proof makes me sick. People get their reputations ruined by people who say " I know she was sleeping around, but can't prove it". Well if you can't prove it, you don't know it was happening. As for the anonymous mailer situation, I didn't see it so I don't know for sure what it said. But assuming it was the kind of stuff that I assume someone would use to recruit a kid (excellent facilities, great history of sports, strong academics, small classes, low discipline problems, high graduation rate, etc), explain to me why its bad for that type of info to be distributed in the first place? The latest craze in the medical health arena is getting more information about health providers to the consumers in the belief that it will create a more informed and better educated consumer. Any reason why we wouldn't want the same result for the consumers of high school education? Only people that would be opposed to that would be the administrators at the poorly performing high schools, and I don't know if I care about their opinions. It's past time that we brought competition into secondary education. Its been ongoing in post secondary education for years with great results.
August 23, 200719 yr Author It's past time that we brought competition into secondary education. Its been ongoing in post secondary education for years with great results. This is a great, great thread topic. Do we want to bring competition into schools and make that a meat market where schools are trying to win over the consumer? Probably shouldn't start that here but is the foundation of this whole debate in public/private. Some are holding on to schools as faces of communities, while others are thrusting schools into the free market society. Kinda like when the mom/pop stores were/are being run out by the Walmarts. Would be an interesting thread, maybe more in line of General Discussion.
August 23, 200719 yr I firmly believe that the system would work better if those who make allegations were required to do so for the record and that the record be available to the school being accused and, possibly, to the public in general. If this were the case, the abundance of whining, false accusations, and innuendoes would dramatically decrease. Our legal system requires that we be allowed to confront our accusers. This practice should be extended to the KHSAA.

August 23, 200719 yr IMO, the core of this whole issue is an allegedly unenforcable by-law. Wouldn't the resolution that makes the most sense be to revise the by-law?
August 23, 200719 yr As I interpret this bylaw it is considered recruiting for a parent, student or coach of a high school, to talk to a student from that high school's middle school feeder about the positives of their athletic programs. Would this be considered influence? Is my interpretation correct?
August 23, 200719 yr Author IMO, the core of this whole issue is an allegedly unenforcable by-law. Wouldn't the resolution that makes the most sense be to revise the by-law? If you can regulate the situation of recruiting, yes. I am not sure that is possible as I have argued many times. To me, it is no different than saying we need to do something to force parents to care about their child's education. How do you do that? How do you prevent parents/players talking to other parents/players about attending the school their children attend? I am not sure a)you should try and stop that but that is so much of the recruiting going on; b)it should be stopped. So, in essence, you would be trying to stop something that is in itself a "good" thing.

But they know what is going on, just can't prove it. I dont know of any police officer that reckless. If there is cash flowing for a 'scholarship' then it should not be hard to find. Money leaves trails.
August 23, 200719 yr This is a great, great thread topic. Do we want to bring competition into schools and make that a meat market where schools are trying to win over the consumer? You seem to think it would be a "meat market" with the meat being kids. I think you are missing the boat. The meat would be the schools trying to sell themselves (in the market) to families. That would be a GREAT thing! The schools would be FORCED to improve.

Where did I say anything about reckless? I am not talking about arresting people on what they know but can't prove. Just they know who is doing what from their informants and such but cannot yet prove it.
