Justice Kennedy to Retire?

Featured Replies

Speculation is that Justice Kennedy is considering retirement in the near future.

You think the objection and tactics to stall Judge Gorsuch's selection was something? Wait for this one.

Still not a shift in the court if he is replaced by President Trump. Now if Justice RBG were to retire that would trigger a significant shift and that's when the delays and hand wringing would really crank up.

He is considered to the the swing vote. He has gone conservative as well as going "left" on issues such as gay rights and abortion. It's a big deal to the liberal side.

To that end is he, but I think it would be much bigger if it was a stalwart of the left like RBG.

I get what you're saying. I'm saying the Ds are going to FIGHT this one HARD.

Well yeah, they are going to fight anything hard. But I understand what you are saying too, if he swings left half the time that would be a big loss for them.

I can't begin to imagine the hue and cry that would be raised if RBG had to leave the court. It is true that Justice Kennedy votes independently at times. But would not nearly have the impact of a RBG retirement.

Depends on what issues are important to you. If you think Roe V Wade should be upheld then Kennedy is just as important as Notorious RBG.

I think next time around President Trump needs to promote a moderate Judge to the Supreme Court.

He is not going to make his base mad.

I don't think Roe V Wade should be a litmus test for selecting a justice. I think that decision will cease to be the rallying cry of the left. Depends on the sort of cases SCOTUS takes up for decisions. Many supposed cases were on display at various women's marches since January 20. Roe V Wade was not in the front.

Why? To prevent prolonged obstruction by Democrats and waste valuable weeks, better spent on completing the POTUS' campaign promises? Or to pacify the Democrats? One like Judge Merrick Garland?

Incorrect assumptions on your part.
