Cunningham had the defense attorney on today (who, by the way, is working 3 other murder cases) and he said that Tensing fired as he was falling backwards as a result of the car taking off at high speed.

 

Not sure if the video will support that.

 

I would not expect a trial any time soon. He says the longer they wait the better it will be for his client. He is in no hurry.

The video is going to get directed in so many ways its going to make your head spin. First, Tensing said he shot because he was getting dragged, now his attorney says he shot because he was falling backwards. Whic is it? IMO, there is no progression to the series of events. If you are getting dragged (with as much force as stated) and falling back, I don't think its poosible to get a "clean" head shot off in a matter of 1.5 seconds unless you've got your side arm pulled and ready to go. As for being dragged, I used the vehicle in the driveway as a point of reference when incident took place. That point of reference didn't move in the video until after the shot. JMO.

I'd rather not watch.

You know, the more I watch that video, the more I shake my head and question why Tensing tried to open the guys door and then reached for the seatbelt. That just seems to me to be poor poor police procedure, at least during the initial phase of a stop. Maybe as a last resort in certain circumstances, but that wasn't the case here. Possibly, had Tensing stepped away from the window, ordered DuBose to step out of the car and he refused and started it up...then maybe this whole thing goes down differently.
