Stanziano said it was possible to appeal, but it was unlikely that they would, because it “detracts” from what is being done in Keith’s defense. “As hard as that is, it’s easier than to add this extra layer of litigation.” “He’s upset, but that’s to be expected...He’s looking at being in jail for a long time before this comes to trial, which means he’s going to miss holidays, birthdays...” Stanziano said. “...of course, someone’s answer to that will be, ‘these three people are going to miss all of those dates for the rest of time.’ Yes, but if he didn’t do it, he shouldn’t miss any special days.” Keith has been serving without bond since he was arrested on Oct. 9 for the murder of Daniel Smith, a gold buyer, and Mike and Angela Hockensmith at the ABC Gold, Games and More store on Sept. 20.
December 3, 201312 yr Author Commonwealth’s Attorney Richie Bottoms said it hasn’t yet been decided if prosecutors will seek the death penalty. “It’s under consideration at this point. We haven’t made a final decision on that,” Bottoms said. However, he does agree with the judge’s decision to deny bond. “I think the judge correctly ruled to not give a bond. The detective who testified presented some pretty substantial evidence,” Bottoms said. He explained that some of the evidence found among Keith’s belonging included money bands associated with Smith’s business and a receipt book belonging to Smith which contained a transaction in Lexington from the day prior to the murder. That information, along with the fact that shell casings found at the murder scene matched those found at Keith’s business, was revealed during the hearing. “The strength of the testimony is what gave the court something to consider,” Bottoms said.
