That's simply not true. A cell phone company can pull the record up if ordered to due so. It doesn't matter if the phone is in the bottom of the ocean.

I think you're way off. I think if the message isn't on the phone still its purged anywhere from 2 to 7 days later depending on the carrier. There is no way these wireless companies have the capacity to store that much data that long. I was told by a federal cop and a private invsetigator that President Obama couldn't retrieve an old text if it had been deleted or erased. That was last year though so it may have changed, but I doubt it.

I have a hard time believing some tech guru couldn't figure out a way to recover everything on any electronic device.

 

Of course, I would question whether something like this would warrant that degree of effort.

If it's still on the phone? Trust me I tried retrieving delted texts early in 2010 and I couldn't do it. I had a PI with a good contact at my wireless company and he said they can't store them and they are gone in 7 days. 7 days is the longest they're stored. Some phone comapnies store them 2 days. Even if the cops obtain a search warrant they wouldn't be able to retrieve delted texts. There are how many phones and text messages per phone? Where would that data be stored?
