November 18, 200817 yr ^Everyone will take this a lot more serious, when all this happens........and Obama returns from the grave to save the Earth from global warming.........
November 18, 200817 yr This is incorrect. It depends on when Obama would be unable to take office. If its before the Electors meet, which I believe is Dec. 15, then the above is true. If its after the Electors meet, Biden would become President. Disclaimer: I'm not posing this question to start some conspiracy theory or stir up any anti-Obama or anti-conservative banter. So, here goes. I recently heard that the Supreme Court has ruled that Obama must produce an "authentic" copy of his birth certificate as proof that he was born in America. Whether this is true or not, is not my point...it's just the background of my question. Hypothetically, if it was determined that he was born on foreign soil, I heard that the election would default back to McCain/Palin. Is this true? I've had little interest in the Obama birth controversey and I know little about it. This just raised an interesting hypothetical scenario that made me curious about what would actually happen should it happen now or ever?

November 18, 200817 yr Care to share with us where you heard that? Somewhere on TV. Does it matter? Its not relevant to the question I asked. How about I re-phrase the question so as not to offend any overly sensitive Obama supporters? Hypothetical scenario...totally unrelated to the current election. What if Person A won a national election for president over Person B, and before the electoral college made the results official on December 15, it was determined that he was not born in America, therefore not allowed by law to be the president...what would happen? Who would be the president? Would there be another election? Would the current president stay in office? Would the current president stay in office until another election could be conducted? Would Person A's VP get the job? Or would the president default to the second place campaign in the election (Person B in this example)? Or, does anyone even know what would happen should something like that occur?

There would probably be a re-election or something like that. Someone with a much, much better grip on election law would have to say definitively.

Someone with a much, much better grip on election law would have to say definitively. Sounded a bit strange to me as well...I was hoping someone could answer my question. If nothing else, this election and all the hoopla around it has brought up scenarios and questions that I would have never dreamed of otherwise. I'm just curious as to what kind of system we have in place to handle some crazy, unexpected occurrence.

November 18, 200817 yr Read post 29. I read that post earlier and totally missed the answer. My bad. So, basically, the electors could choose anyone they want? That would be really interesting. I wonder who they would choose...and how that process would shake out. Talk about some shady interaction and under the table deals...I bet it would be similar to a book I read about the selection of a pope in the middle ages. Cardinals cutting deals with each other for land and power to secure votes for pope. It's called "The Family" by the way. Mario Puzo started it, but died before its completion and I think his daughter finished it up. It was a very interesting book. Fiction, of course, loosely based on history, I think. (Borgia, I think was the name.) You think the EC would send up a white smoke signal when they decided on their new POTUS? Could the electors decided to keep George Bush in office?
November 18, 200817 yr The electors are not constitutionally bound to vote for the candidate that their state voted for. However, most states have fines and penalties for "faithless electors." The point is, should Obama not become ineligible before the electors vote, Obama's electors would probably vote for Biden. Then again, they're not required to. Party politics could swing the electoral votes to Hillary. Or the president-elect's ineligibility could split a party's electoral votes and throw the election to the other party. As long as the president-elect was alive, I would guess that his party would fight off any challenges to his competency and eligibility until after the electors are seated and have voted.

You're a braver man that I am for criticizing this great man.
