For example, if you murder a pregnant woman, you are likely to be charged with 2 counts of murder. However, if the woman had opted for an abortion before she was killed, the dead baby is still dead, but the murderer is down to just one count. Sorry for such a macabre example. If abortion was legal through the first 3 months, then it shouldn't be possible to murder an unborn child in that time. Since abortion is now legal at any time before birth, there should be no such thing as fetal homicide. It should be relegated to a civil action under destruction/conversion of private property. BTW, I'm very Pro-Life. Don't be too impressed by the trimester approach. That concept was "created" by Justice Blackmun in his majority opinion in Roe v Wade. But I am not 100% positive on that. I do know that if a pregnant woman is smoking crack she can't be charged with any crime involving the fetus prior to birth. It's okay to kill them in the womb but how horrible are we as a country to not provide them healthcare for their earaches. Death in womb--acceptable. Earached--Unacceptable. Be consistent.
