Several great points were just made on the FoxNews coverage of this by Greta Van Stuteren and others.

The three victims of Mike Nifong got justice only because they could afford to pay in excess of 1 million dollars in legal fees. What if they were poor people who could not afford that? She also wondered if there would be disciplinary proceedings against the assistant DAs in Nifong's office because as officers of the court they had a duty to report misconduct even had it resulted in their dismissals.

They also brought up the very vocal protests of Al Sharpton, the Black Panthers and others when they had convicted these young men based on the statements of Nifong.

Finally, that the risk of turning this into a liberal vs. conservative issue Bernard Goldberg described this as an example of liberal McCarthyism. A poor black woman accuses affluent white young men of rape. They were condemned by their professors, they were condemned by the president of their University. There were wanted posters with pictures of the entire Duke Lacrosse team posted on campus. There were death threats. There were newspaper editorials condemning these young men. Will there be apologies forthcoming from them?

Apologies aren't enough.

I haven't been following too closely, but have the players been completely cleared on all charges?

This one I don't believe in. The defense attorneys didn't do anything out of the ordinary, in fact they look pretty inept in this case as well. It was a simple fact - no DNA from the Duke players was found on the woman. Very simple fact that costs a few hundred dollars to figure out, doesn't cost $1MM in attorneys' fees to figure out.

In November the AG from North Carolina not only dismissed the charges, he declared that they were innocent and the victims of a rogue prosecutor.

I disagree.

One of Nifong's victims had an iron clad alibi and Nifong refused to consider it. Nothing was going to make Nifong give up this case prior to the primary and once that happened he had to keep it if he was to have any chance of saving face.

DNA testing was done and the results, which exonerated the victims, were never turned over to the defense. The case may have gone to court and them been either dismissed or they probably would have been aquirred but they wouldn't have gotten the declaration of innocence.

Nothing short of the defense attorneys fighting in their clients ineterests could get Nifing to quit and the only reason that happened was because they were being very well paid.

Wrong 100%. The charges were dropped because of the DNA not matching. There are DNA tests done every day in this country and you don't have to pay lawyers $1MM to get the results. The charges would have been dropped as soon as the DNA results were made known (and were), which WOULD have happened (and did) before this case ever went to trial. The AD got Nifong to quit when he dropped the charges after the DNA results became known. Maybe you want to argue that the DNA tests never would have become known if not for the genius of the $1MM attorneys?

No they weren't.

As I recall it became known that the DNA didn't match any of the defendents in May. That's when Nifong made the comment that they could have used a condom so it didn't prove anything and the case continued. What wasn't revealed was that samples from 4 other men were found. Nifong said he didn't reveal that to protect the identities of those men. It was only through other legal maneuvering and evidence of wrongdoing that Nifong took himself off of the case and the AG took over, and even then it was 3 months until the young men were declared innocent.

In fact all three of the victims wete indicted AFTER the results of the DNA testing became known.

BRJB you did not follow this case. The job of the defense attorneys was round the clock, out of your head, unbelievable. They had the prosecutors office twisted in knots on TV, long before the DNA test results were even being discussed. I'm sorry to be so blunt, but you are out of your element on this one.

Please keep the personal attacks out of it. I guess I am out of my element. My element knows without a DNA match, the case gets tossed. WHICH IT DID. And my element doesn't need to spend $1MM to figure it out.
