Louisville judge questioned for dismissing juries based on lack of minorities

Featured Replies

I don't know the legality of this, but I don't have a problem with it.

A jury should be a nice cross section of society. We don't allow all male or female juries, so why have all white?

We don't allow all male or female juries? I know you can't exclude based on sex but you can't exclude based on race either, can you? I was under the impression that same sex juries are not barred.

I'm not crazy about what he did here. Those called for jury duty are selected at random and the 40-member panels from which a jury is selected are also taken at random. 37 of the 40 panelists were white. Not much either side can do about that.

It's not like there was a Batson issue and the prosecutor tossed the black panel members off the jury. The defense attorney got the jurors he wanted as well. It was all done above board and this was the result.

Still, I understand the concerns and the history involved in this.

My biggest problem is the timing. They went through an entire day of voir dire and ended up empaneling a full jury. Only then did the judge decide that something was wrong with the jury and wrong with the panel. Why?

Thanks for the response.

When I saw which judge did this, I am not surprised.

What will be interesting is the ruling the KY Supreme Court issues. This could make it all the way to the SCOTUS.

Wow... just read the story of the home invasion. This guy is nuts.

Come on now, this is almost unbelievable.

Bgp'ers please google this guy and read this home invasion story.

I believe the premise behind the action makes sense. We should have a jury that represents the population at large when possible.

But the procedure or approach to accomplish it , we'll it doesn't sit well.

Where does it stop?

Where does it stop?

For some, it never does.

The jury pool is picked randomly, by computer, in Frankfort no less, based on DMV and voting records.

Another thing to remember, not all that are sent notices to report for jury duty show up.

I don't agree with the judges actions. I just understand the mindset of wanting a diverse jury. If the judge has the problems with the results of random selection he should look to fix that process not abuse his powers.

How do you propose to fix something that is completely random?

I really doubt he would have dismissed an all black jury.

I'm not saying it needs to be fixed or even it does it could be any better than it is now.

My point was just to say I understand the utopian thought of wanting a diverse jury. I've stated many time utopia isn't reality.

I never agreed with the judges actions to achieve his goals. I'm against any politician who abuses their power. Whether it's a county clerk denying marriage license to gay couples or a judge playing king on what the perfect jury is.

We agree.
