Nikki Autry, who resigned after the botched raid, has been charged with federal civil rights violations for providing false and misleading information to a magistrate judge in order to secure a warrant for a no knock warrant. The warrant led to a raid in which another officer lobbed a flashbang grenade into the crib of 18 month old boy. The boy has required a dozen surgeries to repair his wounds. The surgeries have cost the family over $1 million in medical bills that the county has refused to pay. No drugs were found at the house.

“Our criminal justice system depends upon our police officers’ sworn duty to present facts truthfully and accurately – there is no arrest that is worth selling out the integrity of our law enforcement officers,” said Acting U.S. Attorney John Horn in a statement. “In this case, Autry is charged with making false statements to a judge in order to obtain search and arrest warrants. Without her false statements, there was no probable cause to search the premises for drugs or to make the arrest. And in this case, the consequences of the unlawful search were tragic.”

But prosecutors now say that Autry, a 10-year department veteran, gave an affidavit to a Habersham County magistrate judge based on false information.

 

Autry, who resigned after the incident, told the judge that a reliable informant had bought drugs from someone standing outside the home the Phonesavanhs were staying in.

 

In the affidavit, Autry told the judge the informant had provided details in the past that led to criminal charges.

 

Prosecutors said the informant was actually 'brand new' and it was not him but his roommate - who was not working with the task force that executed the raid - who allegedly bought a small amount of meth. There was no surveillance to verify the purchase

 

Investigators said Autry knew the informant didn't buy drugs from anyone inside the house and the new informant wasn't a proven reliable source.

 

They say they police officer also didn't confirm there was heavy traffic coming and going from the house before she gave the affidavit to the judge who issued the 'no-knock' warrant - executed around two hours later.

 

Prosecutors said the judge issued the warrant based on false information that Autry is accused of providing.

 

Federal court records do not list an attorney for Autry, who could not be reached for comment.

I'd have thought even if there was no illegal activity on her part, that the counties insurance carrier would have picked up those bills. In the end the family will not have to pay anything, but I know worrying about it also isn't good for the family either.

I'm not sure if it was in the article or not but the county has refused to pay for the family's medical bills. I've mentioned it in previous threads on this incident. I'd have to think this would be a slam dunk lawsuit given the prosecution of the officer that obtained the warrant and the county's disbanding of the task force that carried out the botched raid.
