The normal age of consent is 16. However, in KY, and I assume most other states, the legal age of consent is 18 and graduated from high school if it involves a student/teacher relationship.

 

In general, think of all high school students as 15 when it comes to sex with a teacher and you are in the ballpark.

I have mixed feelings on it but I hear what you are saying.

 

I certainly think it is a horrible idea for a teacher to get involved with a student but making exceptions (changing the law in this case) is a slippery slope.

 

I liken it to the management level employee of a company sleeping with his assistant or secretary. Nothing wrong with two consenting adults doing whatever they want. The company may not allow it if they find out, which is 100% their decision, but it's nothing criminal.

I understand that, I'm of the belief that the bolded is an unnecessary law. JMO.

 

It comes down to the position of power. Student/Teacher should be forbidden until the school year is over IMO. I know that there are alot of educational administrators, whose wives are teachers. That shouldn't be allowed if the student/teacher isn't.

I don't know the answer and would have to research it. That KRS is probably on the site somewhere if you want to post it and/or look it up on Google and we may be able to tell from the statue and then again we may need case law or an AG opinion.

If you're not a teacher at the student's school then what authority would you have? The contact must come as a result of the authority.

I think the key phrase is "a position of authority or position of special trust" ….still not sure it is clear. There is also a statute that defines the defense of the abuse where the perpetrator can claim that had no knowledge the victim was not of the age of consent at the time of the action….

Put me with CC, I am thinking the statue would not apply to a teacher from another school.

That law was changed to 18 in 2012 I believe.

I don't know if it's 16 or 18. Either way, I think you're missing the point.

 

A teacher is considered a "position of authority." At their school, they share responsibility for their students. Some of those students are 14, some 16, some 18. The legislature, in its infinite wisdom, decided that it was good public policy to prohibit anybody in a position of authority to have sexual contact with a minor when that relationship began as a result of the adult being in a position of authority.

 

I understand where you're coming from but disagree. You simply cannot treat high school students as adult employees, even if the students are of legal age.

One line in the article says "she teaches him chemistry." Alrighty then.
