Then it's no-fault... You can't expect the skateboarder to be responsible for seeing the kid, but the kid not be responsible for seeing the skateboarder.

 

As for the video, the woman clearly wasn't watching her kid, as she wasn't even the first person that got to him. He is a much better man than me, because at the very least, she would have been in jail very soon after this incident. Her poor parenting was just as much at fault for this accident as the guy on his skateboard.

 

Pretty convincing to me as I saw it.

It could have easily been a kid on a bike, or someone pushing a stroller. Is the mother going to beat up the kid on the bike or slam the kid in the stroller? I can understand her being upset but there was no call for her to get physical. Just because you have kids doesn't mean you're mature.

Three points:

 

1. I certainly can see a punch being thrown in retaliation. That lady threw a man's punch.

2. The kid probably won't do it but he needs to file an assault charge.

3. And what does it happening on his birthday have to do with anything?

It's obvious in the video that he is outside the actual skate park. There are many people wondering around that area where he is skating during the accident. Barely out or not...he's out and it becomes the skateboarder's fault at that time, IMO.

 

Again, all that being said, it still doesn't give the woman the right (no pun) to throw a punch.

 

If it doesn't say "No Skating" where he was, then the kid is equally responsible.
