Utah Police Shooting With Video

Featured Replies

He didn't have a gun. Fact.

They shot and killed him. Fact.

Sure seems like that's what happened.

How do you put those two together and think they shot him because he might fit a description?

That isn't what happened. If they were going to shoot him because he kinda looked like someone, they would have gotten out and shot him immediately. They didn't do that.

You like to ignore some facts to present an argument that isn't true.

Look up the term totality of circumstances.

There is no obvious answer, that's the problem with people like you. You think everything is so easy when your life is potentially in danger. It's easy to MMQB a decision from the safety of your home when you know nothing is going to happen. Fortunately, thats not how it works. When you determine whether or not force was justified, you consider the totality of circumstances based on what the officer knew at the time. People who understand the law better than you or I decided this was justified. Unfortunate, and tragic, but justified.

You ignore several other factors because they don't fit your agenda. He didn't just "fit the description", like you say.

People like me are tired of people like you playing judge, jury and executioner... :idunno:

So he deserved to die because he fit the description of someone who might be carrying a gun, didn't listen to their commands, and lifted his shirt up to show his waistband? Is that your stance?

People like me? I've never shot anyone in my life. What the heck are you talking about?

You have no clue what you are talking about. Maybe you watch too much MSNBC. You have heard some bad information re: unjustified police shootings that makes you think it's common. Do some research...don't rely on the media.

Did I say he deserved to die? Why do you say things that aren't true?

I'm saying that the Officer's actions were justified based on the totality of circumstances.

"A totality of the circumstances standard suggests that there is no single deciding factor, that one must consider all the facts, the context, and conclude from the whole picture whether there is probable cause, or whether an alleged detention is really a detention, or whether a citizen acted under color of law."

Obviously the guy didn't deserve death. But that doesn't mean the officer killed him because he fit a description, or because he wanted to kill someone that day.

You're playing semantics, but change "He deserved to die" to "He was shot because" and then answer the question.

You want to start throwing around "people like you", you better be ready for it headed right back at you. You know exactly what I meant, but keep playing dumb...

The point remains the same. Our laws state that the totality of circumstances must be considered. We don't pick and choose facts to include when determining whether something was justified.

You aren't getting it. He wasn't shot because he fit a description.

That was part of it. The other parts are he ignored commands, and reached towards his waist.

And he didn't raise his shirt for a couple seconds as far as I could tell. Looked more like less than a second.

We don't pick and choose facts to include when determining whether something was justified.

What facts are being left out? Can you give us a break down of the facts as you see them in this situation?

I have...several times

You aren't getting it. He wasn't shot because he fit a description.

The officer told him twice "get your hands out." After the second command, he pulled his hands out, and the guy shot him...

And you think that's justification to kill someone?

As he was still walking backwards away from the officers.

And you think that's justification to kill someone?

I agree with this.

“Officer Cruz’s belief that Dillon Taylor was armed with a gun and intended to use it against the officers was reinforced by Dillon’s actions and the acts of others,” Gill wrote. “By the time Dillon drew his hands from his waistband, Officer Cruz’s belief that Dillon was presenting a weapon… was reasonable.”
