  3. No, that was me typing before thinking. I don't know why he transfered. Does anyone really know besides the Mitchell's. What I do know, He moved, changed residences.

     

     

    I don't believe the bylaws intends for the player to have the "benefit of the doubt" when requesting a waiver.

     

    The onus of proof is on the student/parents to satisfy the KHSAA Board of Control that a move is "not for athletic purposes". It's pretty vague, but that's how it's currently done, I believe.

  4. All Tell, one of my biggest complaints is that the KHSAA hearing officer ruled him eligible. Two, the rule is a joke. There's no rhyme or reason to it. IF Mitchell would have moved to a school outside of the NKY area and his parents moved he would have been ruled eligible like SO many others have done. Because he moved to a different school that is in the NKY it's not legal. What's the difference??

     

     

    IMO, the move would then have been seen as "legitimate"...

     

    Who knows, maybe KHSAA is secretly using a certain # of miles as a "rule of thumb" to judge whether moves are seen in a positive light... :sssh:

  5. oneijoe, I believe HHS was listed as a defendant when the Mitchell's took it to court. I'm not disagreeing with you but what do you tell the kid when the courts ruled in his favor. The sad thing is if the KHSAA would have been consistent with this rule from day one we wouldn't be having this problem right now. The first time they granted a waiver of this rule they opened up a can of worms.

     

     

    Oh, you're right. Mueller was in quite a vice on deciding what to do (not legally, but morally and ethically). He either plays him and run the risk of what has happened, or not play him and risk his stature with his players. :sssh:

     

    All of this is yet another reason for the "All or None" suggestion in the transfer thread we had... (let's please not start that discussion again, though ;) )

    Does this imply the game will be played and if Highlands wins the KHSAA will THEN decide on whether they'll be awarded the Title ?!?!?

     

    IMO, this would amount to putting an * next to their name if they win...

  7. I agree 3, but as a coach did Dale have a choice. Once the injuction was in place what is is reasoning not to play one of your best players. Doesn't Dale have to honnor the court's ruling?

     

     

    Absolutely NOT... the original injuction only granted him temporary protection from KHSAA action, NOT the right to play for Highlands.

     

    The only way Mueller would have been "forced" to play him would have been for Mitchell to also be granted an injunction against Highlands.

     

    THAT was the decision Coach Mueller had to make when this stuff came about before the season.

     

    He threw the dice... and they came up "snake eyes".

  8. Well, one thing's for sure: with the timing of this ruling, it is clear that somebody (either the KHSAA or the Court of Appeals) really wants to nail Highlands.

     

    As for the comment about HHS winning without Mitchell, I think the guru is being way too optimistic about HHS' chances without the kid. He is the best guy on the team, and one of the very best players in the state. The team will have very little time to prepare for BC with him out of the gameplan. HHS beating BC with Mitchell is an iffy proposition. Without him, Boyle Co should be considered the favorite.

     

    One last thing: I am hearing from some that this issue is not over, and that there will be more court stuff this week.

     

    Can Mitchell even practice with the team at this time?

     

     

    I hate for this to happen to any team...(yes, even to the Birds ;) )

     

    Unfortunately, it's a chance that's taken when the temporary injunction was sought.

     

    About the timing... Though it seems suspicious, it's not much different than the timing on the Yates case last year (though that was ONE day before the regional semi).

    Until I read it, you had me convinced the independents should be in their own class along with the private schools...

     

    There ARE a lot of competitive ( though not necessarily unfair) advantages in these systems over regular public schools....

    guru... There are hard to explain rankings in each one. You say Massey has a WKY bias. A lot of us in EKY feel that way toward the Litkenhaus, and to a lesser degree, the Cantrall. IMO, wayyy too much weight (free points - ie, Campbell Co.) is given 3A and 4A teams simply for their size. Granted, they usually are playing better teams, but simply "showing up", to me, isn't enough.

     

    I must add, being an EKYian, there's a certain amount of humor in hearing a NKYian claiming a poll has a WKY "bias".. lol.. NKY is usually the first to discount any anti-EKY bias claim.

    2A should be better than A, but the fact we have this debate is a sign that 2A is weaker than it should be.

     

    2A is certainly stronger. IMO, the reason we're having this debate is because the traditional powers in 1A (Danville, Mayfield, Beechwood, NewCath) are BETTER known by the people in the state's metro areas. This then gets translated into a gross overestimation of these team's class strength. 2A, with its dearth of traditional powers, gets grossly UNDERestimated. Look at the poll results....

     

    LOL, even though Massey is my "favorite" rating, it doesn't mean I give much credence to it. I like Massey because of all the other information included on the site. With Lit and Cantrall, one just gets bald numbers. There's no fun in that.
