February 19, 201115 yr I am certainly not a legal expert nor do I pretend to be. With that I don't see any comments listed above that would cause a re-trial. We have no test for jurors. We do not pass out a survey at the end asking why they voted the way they did. They are given instructions but from there it's really up to them. It's not a perfect science which is why I'm generally against the death penalty.

They were told not to take anything into it either way that he did not testify. But they did. If he "snapped" then manslaughter would have been more appropriate. And they are deciding themselves how it all played out, and not going with the evidence, such as where she was supposedly killed, prosecution says bathtub but some jurors throw that out on their own and decide that she was downed in the toilet. They just awarded him a 4th trial. Again, I see it being moved this time since they can't find 12 people in Warren Co to do something right.

I agree that there may not be enough to throw out the verdict, but there is no doubt in my mind this jury was brutally bad. They didn't follow instructions and there was enough chatter during the trial about a juror saying he was guilty after two days of evidence that the judge made a point to stop the trial and tell them to shut up. There is no way this trial should have gone on in that county.

I agree, when I heard that juror on the phone calling into 700 wlw I just shook my head and thought, here we have a double digit, redneck who obviously had a bias against Widmer before the trial even started, calling into a station to get his fame 20 minutes after he left the courtroom. His call was suddenly dropped so I dont know if whoever he was with told him to cut it off or what but he just sounded like someone that I wouldnt want determining my fate.
