I'm assuming thats why they filed in Texas. That and they're seeking a jury trial. I don't think the jury in KY would be too friendly.

May 31, 200917 yr The lawsuit doesn't specify the MOU at UK. It claims UK interferred with Texas A/M during his renegotiation, which means he didnt get the money he expected to get from TAMU. There's no chance that Billy G will get money that he "expected" from A&M. I'dimagine that part of the complaint will be dismissed. He's claiming interference in his negotiations with Texas A&M. Regardless, I think he filed suit in the incorrect jurisdiction. They may be able to show that Kentucky has sufficient contacts in Texas and prove that TX has proper jurisdiction. That'll be an interesting debate. And since everything is bigger in Texas, maybe he thinks the payout will be higher there. Absolutely. Can't blame him for wanting the suit somewhere other than Kentucky.
