April 21, 200917 yr Pretty sure it still is in most states. And I'm not just talking about homosexuals. So should sodomy be a crime? Why or why not?
April 21, 200917 yr If I remember correctly, sodomy was repealed in most states in the early 2000's. A few states still have laws forbidding sodomy, but I believe that is mostly limited to same-sex instances.
April 21, 200917 yr Author If I remember correctly, sodomy was repealed in most states in the early 2000's. Are you for laws forbidding sodomy in same-sex instances?
April 21, 200917 yr Author What happens between consenting adults is between those adults. In danger of jacking my own thread, I still have to ask this question. What if there is a monetary transaction also taking place between the two consenting adults?
April 21, 200917 yr Kentucky Law: A person is guilty of sodomy in the fourth degree when he engages in deviate sexual intercourse with another person of the same sex.
April 21, 200917 yr I was under the impression that Lawrence v. Texas in 2003 basically tossed out all the sodomy statutes across the U.S.. It is possible that the Ky. statute is still on the books because it isn't enforced and so noone has had to challenge it before a court yet.
April 21, 200917 yr Author It is my understanding that sodomy is generally used in rape cases to further add to the sentence (something of which I'm not opposed to).
April 21, 200917 yr In danger of jacking my own thread, I still have to ask this question. What if there is a monetary transaction also taking place between the two consenting adults? What happens between consenting adults is between consenting adults, even if there is a monetary exchange involved. Yes, I believe that prostitution should be decriminalized.

April 21, 200917 yr It is my understanding that sodomy is generally used in rape cases to further add to the sentence (something of which I'm not opposed to). By the very definiton rape would be sodomy wouldn't it? Deviant sexual activity.
April 21, 200917 yr It is my understanding that sodomy is generally used in rape cases to further add to the sentence (something of which I'm not opposed to). That's very interesting. It means courts are making a distinction and saying this sort of sexual conduct is more offensive or more terrible than another kind. I had no idea. Lawrence v. Texas hinged on privacy grounds, so it could probably be avoided in this situation. Would a jurist basically argue that sodomy itself isn't illegal, but that forcible sodomy is worse than, for lack of a better term, "normal" rape?
April 21, 200917 yr I have some questions, about the definment of the word, but I'm afraid some younger folks might be on here so I'll....., but to answer I'll agree with Alltell.
April 21, 200917 yr It is my understanding that sodomy is generally used in rape cases to further add to the sentence (something of which I'm not opposed to). Sodomy in the 1st-3rd degree all deal with forced, underage or guardian sodomy and are all felonies. Sodomy in the 4th degree is a misdemeanor. And I have personally seen someone get an additional 5 years added on for Sodemy in the 1st degree.
