Babysitter Avoids Abuse Charges Because Baby Can't Describe Abuse

Featured Replies

Let's say this law didn't exist.

How would the abuse be proven beyond a reasonable doubt that it was at the hands of the babysitter? I think the law is just a distraction to the bigger issue - how do you prove anything here?

If the child was dropped off with the baby sitter uninjured, and no one else was around the kid...

Remove the law from the equation. Let's assume Oregon has the same law as every other state.

You charge him. You still have to prove it. It's not a slam dunk. That's my point.

Are you saying it isn't a slam dunk if there's no confession?

According to what I'm seeing here, the prosecutors also didn't charge a misdemeanor for physical harassment, which has a much lower standard under Oregon law. There may be something beyond the outrage here if the prosecutors also passed on charging the misdemeanor.

Babysitter days kid was already bruised. Now what?

Correct.

Babysitter days kid was already bruised. Now what?

Then it's he said/she said. Id want to know why the baby sitter didn't report it if the bruising is bad.

Why are we playing this game? It's not the case for this story.

Did the babysitter admit hitting the child to the police?

Haven't we covered that?

Staten told The Oregonian that he had seen photos of Jacob Marbury’s injuries but not the same ones that were shared on Facebook. After viewing these pictures, Staten said, “Seeing those photos has caused me to want to take a different path.” So maybe Joshua Marbury’s upsetting Facebook post that went viral really did help because it got the attention of the prosecutor and renewed his interest in pushing for charges against Jacob’s abuser.
